The website is published by Casper BidCo, a simplified joint stock company with a capital of 12,129,635.92 Euros, registered with the Nanterre Trade and Companies Register under number 850 790 908, having its registered office at 29 boulevard Romain Rolland, 92100 Montrouge (hereinafter referred to as "Casper BidCo" or "the Operator").
The terms mentioned below have the following meaning in these General Terms and Conditions of Use:
These general terms and conditions of use define the legal framework governing access to and use of the Site and the Application.
These general terms and conditions of use are in English and are intended to apply between Casper BidCo and any User wishing to access the Site and the Application.
Casper BidCo acts as a technical intermediary.
These general terms and conditions of use do not set the guidelines to booking a holiday, which is governed by the general terms and conditions of sale found here.
These general terms and conditions of use come into force on the date they are posted online and will be enforceable on the date of first use of the Site and download of the Application. They apply throughout the period of use of the Site and the Application and until new general terms and conditions of use replace these terms and conditions.
The User may, at any time, cease to use the Site and the Application but remains liable for any prior use.
Access to the Site and the Application is free. The Site and Application are accessible 24/7.
Casper BidCo endeavours to provide quality access and to allow Users to use the means of communication made available to them under the best possible conditions.
Due to the nature and complexity of the Internet network, and in particular its technical performance and response times for viewing, querying or transferring information data, Casper BidCo makes its best efforts to allow access to and use of the Site or the Application, but cannot guarantee absolute accessibility or availability of the Site.
However, Casper BidCo reserves the right, without prior notice or compensation, to temporarily or permanently close the Site, the Application or access to one or more remote services, in particular to carry out updates, maintenance operations, modifications or changes to operational methods, servers and accessibility times, without this list being limitative.
Casper BidCo is not responsible for damages of any kind that may result from these changes or from a temporary unavailability or permanent closure of all or part of the Site and the Application and/or associated services.
Casper BidCo reserves the right to add to or modify, at any time, the Site and/or the Services available therein in accordance with technological developments.
It is the User's responsibility to ensure that the IT and transmission resources at their disposal can be adapted to changes in the Site and the Application.
Downloading the Application is free of charge for the User. However, the cost of using the remote communication, such as mobile data or Internet connection charges, is borne by the User in accordance with the terms of their mobile package and their service-provider.
Casper BidCo reserves the right to add to or modify, at any time, the Application and the Services available therein in accordance with technological developments.
The User undertakes not to create an account under the identity of a third-party. They are solely responsible for the confidentiality of their login details (username and password) enabling them to use their account.
Any use of the User's account using the User's personal login and password is presumed to have been made by the User or a third-party authorised by the User, until the User's account is deactivated.
The Site and the Application enable the User, via a single online entry point, to access their past and future bookings, to reserve their room in any of the hotels listed on the Site and the Application and to provide opinions, feedback and comments relating to their stay in the hotels listed on the Site and the Application.
All offers, booking conditions and contracts relating to a hotel listed on the Site and the Application are offered and must be accepted with the Hotel Company of the hotel concerned, in accordance with the general terms and conditions of sale applicable to bookings made in a B&B HOTELS hotel.
In the event of any contradiction or ambiguity between the clauses of these Terms and Conditions of Use and those of the applicable General Terms and Conditions of Sale with regard to their subject matter, the clauses of the General Terms and Conditions of Sale shall prevail.
The Site and Application also allow the User to subscribe to the loyalty programmes of the B&B HOTELS Group.
From the Site and the Application, the User can access the various holiday offers from the Hotel Companies.
The Hotel Companies' offers are ranked by default according to the following criteria:
When searching by city or point of interest, the hotels are sorted by distance from the location sought;
In the city pages, the order is decided by the countries;
Finally, the offers are ranked in order of price, with the cheapest always being offered first.
The ranking may be changed at the User's discretion. The sorting function can be used to sort hotels according to different criteria, such as distance, cheapest price or the highest rating given by customers.
The filter function can be used to restrict the display of hotels according to criteria chosen by the User, such as price range, facilities and services available, customer ratings or the number of stars awarded to each hotel.
The hotels appear in ascending order of distance for a given search, and the User can then select the sort by price option. The hotels are then listed in a customised way, following the recommendations of an intelligent algorithm that takes into account the Customer's habits, prioritising their tastes according to their purchase history or browsing to make it easier for them to make a booking on the Site and the Application.
Casper BidCo reserves the right to broadcast, free of charge or for a fee, advertising or promotional messages on its Site and its Application.
Casper BidCo reserves the right to set up hypertext links on its Site and its Application giving access to web pages other than those of its Site and its Application over which B&B HOTELS exercises no control.
Casper BidCo declines all responsibility for the conditions of access to third-party sites via hypertext links, for their operation, for the use of Users' personal data and for the content of the information provided on these third-party sites.
The User who has a personal website and wishes to place, for personal purposes, on his site a simple link referring directly to the home page of the Site or the Application, must obtain the express authorisation of Casper BidCo to establish this link.
Under no circumstances may this authorisation be construed as an implicit affiliation agreement.
In any event, hypertext links to the Site and the Application without the authorisation of Casper BidCo must be withdrawn at the first request of Casper BidCo.
In accordance with the Regulations relating to the protection of personal data, Users are informed that personal data is processed on the Site and the Application.

Casper BidCo cannot be held responsible for:
- the quality of the Site and the Application, the Site and the Application being offered "as is";
- breaches of computer security that may cause damage to Users' computer equipment and data;
- infringement of Users' rights in general.
Casper BidCo may not be held liable for any direct or indirect damage that may result from downloading, accessing or using the Site and the Application or the information contained therein, whatever its nature.
Casper BidCo makes its best efforts to provide up-to-date information on the Site and the Application. All the information made available to persons accessing the Site and the Application was selected on a given date.
The information appearing on the Site and the Application reflects an opinion at the time of its creation and not at the time of viewing of the Site and the Application. It may require updating, which may not have taken place at the time of viewing for technical or other reasons.
Casper BidCo shall not be liable for any errors or omissions in the information provided on the Site and the Application. Any update, new service or new feature that improves or enhances one or more existing information contents will be subject to these conditions.
Casper BidCo declines all responsibility concerning the appropriateness of decisions made by Users solely on the basis of information published on the Site and the Application.
Once the User's stay is over, they will receive a form by email allowing them to summarise their experience. They will be able to evaluate and describe what they enjoyed during their stay in a hotel listed on the B&B HOTELS site.
Their opinion will then be published on the page of the hotel where they stayed.

Users may also give their review on their browsing experience on the Site and the Application. These reviews are collected via a pop-up window prompting the user to rate and comment on their browsing experience. These ratings and comments are stored in a tool and analysed to improve the online user experience. These reviews will not be published on the Site or the Application.
The User undertakes to use the Site and the Application and all the information to which they may have access only for purposes that comply with public order, accepted standards of behaviour and the rights of third-parties.
Users undertake to provide accurate and up-to-date information, particularly when creating their account.
In the event of non-compliance with the general terms and conditions of use of the Site and the Application, Casper BidCo reserves the right to deactivate, automatically and without compensation, the User's account after sending an e-mail which has remained without effect for 30 days.
In the event of obvious and significant breach and/or fraud by the User, the account will be deactivated ipso jure, without notice, formality or compensation.
The User also undertakes not to disrupt the use that other Users may make of the Site and the Application and not to access parts of the Site and the Application to which access is reserved.
In accordance with Articles L. 111-1 et seq. of the French Intellectual Property Code, Casper BidCo holds the intellectual property rights to the Site and the Application, which constitute intellectual works.
The general structure and content of the Site and the Application, including the texts, slogans, images, whether animated or not, photographs, logos, software, as well as any other element making up the Site and the Application, are the exclusive property of Casper BidCo or third-parties who have granted it a licence.
Any reproduction, representation, use or modification, by any process whatsoever and on any medium whatsoever, of all or part of the Site and the Application and of all or part of the various works that make it up, without the express authorisation of Casper BidCo, is strictly prohibited and would constitute an infringement liable to incur the civil and criminal liability of the infringer.
These general terms and conditions of use do not imply any transfer, of any kind, of intellectual property rights on the elements belonging to Casper BidCo or on the elements of third-parties who have granted it a licence, for the benefit of the User.
The User therefore undertakes not to take any action or perform any act likely to infringe directly or indirectly the intellectual property rights of Casper BidCo and in particular not to modify, copy, reproduce, download, disseminate, transmit, commercially use and/or distribute, in any way whatsoever, the pages of the Site and the Application, or the software codes of the elements making up the Site and the Application.
The distinctive signs of Casper BidCo and its partners, such as domain names, brands, names and logos appearing on the Site and the Application are protected by the Intellectual Property Code. Any reproduction in whole or in part of these distinctive signs made from elements of the Site and the Application without the express authorisation of Casper BidCo is therefore prohibited, within the meaning of the French Intellectual Property Code.
The Site and the Application may only be used in accordance with their intended purpose. Any other use, not expressly authorised in writing and in advance by Casper BidCo, is prohibited and constitutes an infringement.

The Parties mutually agree that the fact that one of the Parties tolerates a situation, regardless of its frequency and duration, does not have the effect of granting acquired rights to the other Party, or of modifying these general terms and conditions of use.
Furthermore, such tolerance cannot be interpreted as a waiver of the rights in question.
In the event of difficulties of interpretation resulting from a contradiction between any of the headings appearing at the top of the clauses and any of the clauses, the headings will be declared non-existent.
If one or more of the stipulations of these general terms and conditions of use are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.
These general terms and conditions of use of the Site and the Application are governed by French law.
This applies to both substantive and procedural rules, regardless of where the substantive or ancillary obligations are performed.
In the event of a dispute arising between the Publisher and a User concerning the interpretation, performance or termination of these terms and conditions, the Parties shall endeavour to settle the dispute amicably.
In such a case, the User is requested to first contact the Operator's mediation service using the complaints form provided for this purpose: https://www.hotel-bb.com/en/help-contact/contact-form.
If no agreement is reached, an optional mediation procedure will be proposed, which will be conducted in a spirit of fairness and good faith with a view to reaching an amicable agreement in the event of any dispute relating to this contract, including its validity.
Pursuant to Article L. 616-1 of the Consumer Code, the Operator shall inform the consumer of the contact details of the consumer ombudsman to whom it is associated. The consumer may thus contact the Tourism and Travel Ombudsman, whose contact details are as follows:

The Tourism and Travel Ombudsman may be contacted within twelve (12) months of the first complaint.

The Party wishing to initiate the mediation process must first inform the other Party by registered letter with acknowledgement of receipt, indicating the elements of the dispute.
Since mediation is not compulsory, the consumer or the Operator may withdraw from the process at any time.
IN THE EVENT THAT MEDIATION FAILS OR IS NOT ENVISAGED, THE DISPUTE WHICH MAY HAVE GIVEN RISE TO MEDIATION SHALL BE REFERRED TO THE COMPETENT COURT.
WITH REGARD TO PROFESSIONAL USERS, THE DISPUTE MAY BE SUBMITTED TO THE COMPETENT COURTS WITHIN THE JURISDICTION OF THE PARIS COURT OF APPEAL TO WHICH JURISDICTION IS EXPRESSLY GRANTED TO SETTLE THE DISPUTE.
