Object

B&B Hotels offers to its customers the opportunity of signing a subscription rewards program, called B&B HOTELS CLUB, through which they can take advantage of discounts on overnight stays and nights offered with breakfasts up to 60 € and free breakfasts, according to a number of points they accumulate, at any of the B&B Hotels located in France, Italy and Spain (Participating Countries).
The general terms and conditions of the B&B HOTELS CLUB establishes the general conditions of contract defining the rules governing relations between B&B Hotels and each of the members.

1/ Definitions

Customer: anyone who books a room in a B&B Hotel

Member: each Customer who accepts the general terms and conditions of the B&B HOTELS CLUB program for registration and pays the annual fee

Valid Night: a stay spent in a B&B Hotel that contributes to the gathering of the B&B HOTELS CLUB points in order to demand one or more vouchers. Only nights spent by a Member booked via the Direct Channel are deemed as valid.

Direct Channel: Sales at the desk of B&B Hotels, through B&B Hotels websites or mobile app, by phone or emailing directly at the hotel, for B&B Hotels in the Participating Countries. All the sales through a reseller, tour operator or third-party travel agency (such as Expedia.com, booking.com, etc.) are excluded from the Direct Channel.
Point: unit of measure generated by the program, based on a pre-established attribution table as detailed in Section 5.5 below, for a valid stay in a B&B Hotel or any other purchase that contributes to the points gathering.

2/ Conditions of subscription to the program

2.1/ This program is reserved for B&B Hotels customers who have become member by accepting the general terms and conditions of the program and paying the annual registration fee.
The customer can join the program in the following ways: 
-during his stay in one of the B&B Hotels in a Participating Country;
-on internet on www.hotel-bb.com
- on the mobile app of B&B Hotels 

2.2/ All persons of legal age in accordance with the laws in force in the country of the member residence, or in possession of the legal capacity to enter into contracts, can subscribe to the B&B HOTELS CLUB program. The member requires a valid personal e-mail address to subscribe to the program. It is not allowed to share the same e-mail address between two members.

2.3/ There is an annual fee for participation in the B&B HOTELS CLUB program (hereinafter, “annual fee“).  

2.4/ After his subscription, the member receives by email his personal identification number. This number is strictly personal and associated to the name of the member. The subscription to the program can’t be sold or loaned. The discounts and benefits of the program are therefore to be considered personal and not transferable to third parties except for the vouchers which can be transferred to third parties. It is  only allowed to apply discounts offered by the program to reservations made by the member for his/own personal stay. Each member can have only one subscription.

2.5/ The member can view his member account over the Internet at www.hotel-bb.com. The overview of the accumulated overnight stays in a B&B Hotel, drawn up and stored on the Internet by B&B, are deemed to be correct and complete, unless the member files an objection in writing within four weeks counted from the last date of the stay. The overviews are updated within 5 working days after the last day of the stay by the member in a B&B Hotel under the B&B HOTELS CLUB program.

2.6/ The member shall use and keep his access credentials secret during his participation in the B&B HOTELS CLUB program. The member shall tend to the care of his access data and password to prevent misuse by third parties. Dissemination of the password is not permitted.

2.7/ The member has to notify B&B immediately  via telephone, e-mail or online contact form  of any changes to the details given by him when applying for participation in the B&B HOTELS CLUB program.

2.8/ By joining the program, members consent to receive electronic communications related to the operation and services offered by the program (information messages, points balance, etc.). 

2.9/ The subscription is valid for one year from the date of accepting the general terms and conditions of the program and paying the annual registration fee (eg subscription June 15, 2019, valid until June 15, 2020). In order not to lose the points collected, the member has thirty days, beyond the expiration date of the subscription, to request the renewal of the B&B HOTELS CLUB program subscription. In case of non-renewal within the indicated deadline the remaining points will definitively lost.

2.10/ The member can, at any time, contact the customer service via the contact webform on the website www.hotel-bb.com or at the e-mail address and telephone number indicated above in order to request assistance regarding the correct execution of the B&B HOTELS CLUB program and information on the points acquired.

2.11/ All member's personal data (address, name, etc.) updates or further useful data modifications, can be updated directly by accessing the member’s personal account on www.hotel-bb.com.

3/ Modification of the program

3.1/ B&B Hotels can change the conditions of adhesion to the program, suppress or change some functions of the service due to technological evolution or practical, technical, legal, financial or security needs as notified to the member in each case. 

3.2/ These modifications will enter in force thirty days after the communication to the member. In case of disagreement on the new conditions, the member may withdraw from the contract by informing B&B Hotels within 10 days following the date of receipt of communication. B&B Hotels may, with two months' notice to the member and at its sole discretion, close or replace the B&B HOTELS CLUB program with a comparable program. In case of closure of the program, a period not less of  30 days will be recognized to the members, starting from the expiration of the term of notice, to take advantage of any premiums if accrued.

3.3/  The rights and obligations of B&B Hotels may be assigned or transferred to any other legal entity, provided that such assignment does not deprive or diminishes the rights awarded to the member under the present terms and conditions. 

3.4/ B&B Hotels is also entitled to amend the General terms and conditions at any time provided a one month notice period is given to members. In the event of amendments to the General terms and conditions, B&B Hotels shall take appropriate account of the interests of the members.

3.5/ The member is given advanced written notification of the amended General terms and conditions at the email address last indicated by the member. The member has the right to terminate his participation in the B&B HOTELS CLUB program within 6 weeks of the sending date of the email notification, subject to 1 month‘ notice.

4/ Conditions to end the subscription

4.1/ Members and B&B Hotels may at any time unilaterally withdraw from the B&B HOTELS CLUB program by sending a registered letter with acknowledgment of receipt, with at least one month's notice. If the withdraw is from the Member, the withdrawal will not give right to any reimbursement or compensation for the remaining period until the natural expiration. If the withdraw is from B&B Hotels, the Member will be entitled to a refund of the amount relating to the residual period of validity of the B&B HOTELS CLUB.

4.2/ B&B Hotels reserves the right to terminate rightfully the present agreement and membership of the B&B HOTELS CLUB program, without any compensation of any kind, with immediate effect, with a one month notice period , in the  case of failure to comply with any of the provisions of this agreement;
and without prior notice period in the following cases:
- abusive or fraudulent use of the advantages of this program;
- falsification of the information transmitted to B&B Hotels;
- severely reprehensible behavior or injurious to the interests of B&B Hotels;
- non-compliance with legal provisions
B&B Hotels can not allow an excluded member to subscribe again to the B&B HOTELS CLUB program during 2 years.

4.3/ B&B Hotels reserves the right, at any time, to perform any kind of checks regarding the use of the B&B HOTELS CLUB program and compliance with the rules in this agreement. In case of termination of the agreement for breach of these terms , all the points accumulated will be lost by the member. 

5/ Program functioning

5.1/ Validity of the benefits of the program

The following benefits are valid in the B&B Hotels of the Participating Countries. To benefit from those advantages, the member has to give at the desk of the hotel his name and email or identification number. Online, the member has to connect to his personal account to benefit from its advantages.
The benefits are valid only for stays booked at the desk of B&B Hotels, through B&B Hotels websites or mobile app, by phone or emailing directly at the hotel, for B&B Hotels in the Participating Countries. All the stays booked through a reseller, tour operator or third-party travel agency (such as Expedia.com, booking.com, etc.) will not take advantage of the benefits of the program.
Any room payed at the reception automatic service without any previous booking with the identification number of the member will not benefit from the advantages of the B&B HOTELS CLUB program.

5.2/ The benefits of the program

- 10% reduction on the  room rates (except for promotional rates) and on breakfast rate, in effect at the time of booking, all year round, seven days a week. This reduction is applicable on arrival at the hotel booked and cannot be combined with special rates, special offers and / or promotions or rates events.
- 5% reduction on the promotional room, in effect at the time of booking, all year round, seven days a week. This reduction is applicable on arrival at the hotel booked.
- Dedicated area on the website www.hotel-bb.com accessible through email and password.
- Accumulation of points, for each stay made via direct booking, which allows to gain vouchers that can be exchange by offered nights with breakfasts up to 60 € and free breakfasts.

5.3/ Points accumulation

The member gains 100 points for each night stay, for one room, except for free rooms or rooms payed through a voucher. If the member books two or more rooms for the same night, points are accumulated only for the room he occupies.
Personal points balance can be consulted by each member on his personal account online, accessible through his email and password.
The account login, as well as the accumulated points, cannot, under any circumstances, be transferred, disposed or combined with the accounts of other members or any third parties.
The accumulated points cannot, in any case, be converted into monetary value and cannot give refunds rights of any kind.

5.4/ Points validity

The points accredited to member account will be valid until 30 days after the expiration date of the subscription. If the member does not renew his registration to the program within 30 days, unconverted points will be definitively lost. However, members have the right to renew the subscription until 30 days after the expiration date. In this case, the points will be considered as valid and added with future ones until the next B&B HOTELS CLUB membership expiration date.

5.5/ Points conversion

Once the member has gained 300 (three hundred) points, he has the possibility to have a voucher for one free breakfast in any hotel located in the Participating Countries.
Once the member has gained 500 (five hundred) points, he has the possibility to have a voucher for two free breakfasts in any hotel located in the Participating Countries.
Once the member has gained 1000 (one thousand) points, he has the possibility to have a voucher for one offered night with breakfasts up to 60 € in any hotel located in the Participating Countries. The free stay voucher (1.000 points) consists of one night in a double room up to two guests.
The member can use his offered night with breakfasts up to 60€ voucher for a room booking  (with or without breakfast) whose price is more than 60€, paying the difference between the total price of the room booking and the amount of the voucher.
The vouchers confirmation is subjected to hotel rooms availability. The voucherscan be transferred to third parties. Offered nights with breakfasts up to 60€ are not eligible for points earning.
Once he has collected the required minimum number of points, the member can edit his voucher through his online personal account when he wants. His voucher will then be available on his online personal account. His voucher will then be available on his personal web account.
The vouchers are valid 12 months from the moment they are edited. The member can use his voucher either online entering his voucher number in his basket, or showing it at the desk of the hotel.
Once the voucher-based booking is confirmed (online or when the booking is entered into the electronic reservation system by the hotel staff at the hotel reception), it is considered as used. It cannot be refunded or edited again even if the stay is cancelled.

6/ Liability

The member shall use and keep confidential his /her B&B HOTELS CLUB identification number and password. 

The member acknowledges that B&B Hotels has fulfilled its obligations concerning the essential characteristics and modalities of the IT system managing to support the B&B HOTELS CLUB program. 

7/ Data properties

The information available through the B&B HOTELS CLUB program remain exclusive property of B&B Hotels and affiliates to the B&B Hotels Group.

The member undertakes to use the information he / she becomes aware of on the B&B HOTELS CLUB program exclusively for private needs and to not use them for commercial purpose.

The member cannot reproduce and distribute, even free of charge, information and data found through the B&B HOTELS CLUB program.
 

8/ Personal data protection

B&B hotels will process personal data directly transmitted by members as a data controller within the meaning of applicable data protection laws. The personal data will more specifically processed for the following purposes:
-     To manage the program and process the application for membership
-    To receive electronic communications related to the operation and services offered by the program (information messages, points balance, etc.). 
These above purposes of data processing are necessary and have for legal basis the performance of the rights and obligations arising from the present agreement. 
Personal data of members processed by B&B hotels may be transferred to hotels in Participating Counties to allow the member to use their benefits.  
Personal data of members may also be handled by third parties’ contractors of B&B hotels, managing the information technology systems and portals of B&B hotels, such contractors being subject to security and privacy obligations in accordance with data protection laws. 
Provided the member has given his express and specific consent, the personal data of members may also be used by B&B Hotels and its partners for commercial purposes and marketing research. Such consent may be withdrawn by the member at any time by contacting B&B hotels at the contact details below. 
The personal data of members shall be kept throughout the duration of the subscription of the member. Nevertheless, the data may be kept in temporary archives, prior to being erased, throughout the duration of the period of limitation applicable to any dispute over this agreement. 
The processed personal data shall not be transferred outside the European Union or to countries other than those that are acknowledged as providing adequate safeguards. 
Members shall have a right to access their personal data that is held by B&B hotels, a right to request that any data that is inaccurate, incomplete or out of date be rectified, updated or erased, and a right to oppose the processing of this data, as well as right subject to being able to show legitimate grounds for such a request. Members may also request the portability of their personal data. 
Members may also issue specific or general instructions regarding certain forms of data processing, for the preservation, erasure and disclosure of their personal data after their death. They may modify or cancel these instructions at any point in time. The specific instructions may be registered with B&B hotels. 
•    right of access means that data subjects may ask at any point in time whether their personal data is being processed by B&B hotels, and if so, what personal data is being processed and the characteristics of the processing involved.
•    right to rectify means that data subjects may request that their personal data held by B&B hotels be rectified if it found to be inaccurate. The data subjects may also request that their personal data, if incomplete, be completed inasmuch as this is relevant to the purpose of the processing being carried out.
•    right to erasure means that data subjects may request that their personal data be erased particularly when (i) its retention is no longer necessary in light of the purposes for which it was gathered, (ii) their personal data is being processed on the basis of their consent, and the data subjects wish to withdraw this consent, and there is no other legal basis that might justify the continuation of the processing of the data, (iii) the data subjects have opposed the processing of their personal data and accordingly wish that it be erased, (iv) their personal data was being processed illicitly, (v) their personal data must be erased to comply with a legal obligation under European Union law or French law.
•    right to limit the processing means that data subjects may request the imposition of a limitation on the processing of their personal data (i) where they have challenged the accuracy of their personal data, throughout the duration required to check the accuracy of this data, (ii) if pursuant to any processing that is found to be non-compliant, the data subject would rather limit the processing than opt for complete erasure of their personal data, (iii) if their personal data is no longer necessary for the purposes of the processing but its retention by B&B hotels is still necessary to the persons involved for the acknowledgement, exercising or defence of their rights in court, (iv) when they have opposed the processing of their personal data and they wish to limit its processing throughout the duration required to check whether the legitimate basis invoked is justified.
•    right to oppose the processing means that data subjects may challenge the processing of their personal data. The right to oppose the processing of personal data may only be exercised subject to adducing legitimate grounds pertaining to their specific circumstances. The contentious data processing shall be terminated unless there are legitimate and overriding grounds justifying its continuation in keeping with the applicable rules and regulations. 
•    Right to data portability means that subjects car require, under the conditions laid down by data protection laws, to receive their personal data in a structured, commonly used and machine-readable format, or require B&B hotels to forward them directly to a third party of their choice when it is legally and technically possible.

Members shall also always have of the right to file a complaint with the competent data protection supervisory authority regarding the processing of their personal data. 

9/ Place of jurisdiction

This regulation is subject to French law.  This clause shall not, however, prevent the member acting in his/her capacity as a consumer, to assert his/her rights in one of the territorially competent jurisdictions pursuant to the applicable civil procedural law or in the jurisdiction of the place where he/she resided when concluding the present agreement.

In the event of a dispute, the member shall have the option to have recourse to a mediation procedure or any alternative dispute resolution process. The mediation body designated by Hotels B&B is :

10/ Acceptance of general terms and conditions

By subscribing to the B&B HOTELS CLUB program, the member accepts these general terms and conditions.
