Assunto

Os B&B Hotels oferecem aos seus clientes a possibilidade de subscreverem um programa de fidelização intitulado “B&B HOTELS CLUB”, que lhes permite beneficiar das vantagens descritas em seguida.
As presentes condições gerais definem as regras aplicáveis ao programa de fidelização B&B HOTELS CLUB.

Para efeitos das presentes condições e no que a cada uma disser respeito, as entidades anteriormente citadas são denominadas «B&B HOTELS».
 

1/ Definições

Cliente: qualquer pessoa que reserve um quarto num hotel B&B
Membro: qualquer Cliente que aceite as condições gerais do programa B&B HOTELS CLUB no momento da sua inscrição e que pague a cota anual
Dormida válida: uma estadia passada num hotel B&B que contribua para a recolha de pontos B&B HOTELS CLUB, permitindo ao Cliente beneficiar de um ou vários vales de oferta, também chamados de “vouchers”. Apenas as noites passadas por um Membro que reservou através do Canal direto serão consideradas como válidas.
Canal direto: Vendas ao balcão nos hotéis B&B, através dos sites ou da aplicação móvel dos B&B Hotels, por telefone ou por e-mail diretamente no hotel, para os hotéis B&B dos países participantes. Todas as vendas que tenham lugar através de um intermediário, de um revendedor, de um operador turístico ou de uma agência de viagens terceira (como a Expedia.com, booking.com, etc) estão excluídas do Canal direto.
Ponto: unidade de medida gerada pelo programa, baseada num quadro de atribuição pré-estabelecido, como descrito na secção 6.5 deste documento, para uma estadia válida num hotel B&B ou para qualquer outra compra que contribua para a recolha de pontos.
 

2/ Condições de adesão ao programa

2.1/ Este programa está reservado aos Clientes dos B&B HOTELS que se tenham tornado Membros, ou seja, que tenham aceitado as condições gerais do programa e pagado a quota anual. 
O Cliente pode aderir ao programa da seguinte maneira: 
- durante a sua estadia num dos hotéis B&B de um país participante;
- no site www.hotel-bb.com
- na aplicação móvel dos B&B HOTELS

2.2/ Todas as pessoas adultas ou com a capacidade jurídica para subscrever as presentes condições gerais segundo as leis vigentes no país de residência podem inscrever-se no programa B&B HOTELS CLUB. A subscrição do programa requer um endereço de e-mail pessoal válido. Não é autorizada a partilha do mesmo endereço de e-mail entre dois Membros.

2.3/ A participação no programa B&B HOTELS CLUB está sujeita a uma quota anual.  

2.4/ Depois da inscrição, o Membro recebe um número de identificação pessoal por e-mail. Este número é estritamente pessoal e está associado ao nome do Membro. A subscrição do programa não pode ser vendida ou emprestada. Os descontos e as vantagens do programa devem ser considerados como pessoais e não transmissíveis a terceiros, com a exceção dos vouchers, que podem ser transmitidos a terceiros. Os descontos oferecidos pelo programa só podem ser aplicados a reservas feitas pelo Membro, para estadias pessoais. Cada Membro só pode ter uma subscrição.

2.5/ O Membro pode consultar a sua conta de Membro online no endereço www.hotel-bb.com. O resumo das noites acumuladas num hotel B&B, tal como é estabelecido e mantido na internet pelos B&B HOTELS, é considerado como correto e completo, salvo se o Membro se opuser a isso por escrito nas quatro semanas a contar da última data de estadia. O resumo é atualizado nos 5 dias úteis a seguir ao último dia da estadia do Membro num hotel B&B no âmbito do programa B&B HOTELS CLUB.

2.6/ O Membro deve utilizar de maneira pessoal e confidencial os seus dados de acesso e não os transmitir a ninguém. O Membro compromete-se a proteger os seus dados de acesso, entre os quais a palavra-passe, para evitar qualquer utilização abusiva por terceiros. 

2.7/ O Membro deve informar imediatamente os B&B HOTELS por telefone, e-mail ou formulário de contacto online sobre qualquer alteração aos dados fornecidos no momento do seu pedido de participação no programa B&B HOTELS CLUB.

2.8/ Ao aderir ao programa, os Membros aceitam receber comunicações eletrónicas relativas ao funcionamento e aos serviços oferecidos pelo programa (mensagens de informação, saldo de pontos, etc). 

2.9/ A inscrição é válida durante um ano a contar da data de aceitação das condições gerais do programa e do pagamento da quota anual (por exemplo, uma inscrição que se iniciou a 15 de junho de 2019 será válida até 15 de junho de 2020). Para não perder os pontos acumulados, o Membro dispõe de trinta dias após a data de término da inscrição para pedir a renovação da sua inscrição no programa B&B HOTELS CLUB. Em caso de não-renovação no prazo indicado, os pontos que restam serão perdidos definitivamente.

2.10/ O Membro pode, a qualquer momento, contactar o serviço de apoio ao cliente através do formulário acessível a partir do site www.hotel-bb.com ou enviar um e-mail para o endereço adequado referido no artigo "Assunto" das presentes condições ou ligar para o número de telefone adequado referido no artigo "Assunto" das presentes condições, para pedir assistência relativamente à correta execução do programa B&B HOTELS CLUB e informações sobre os pontos acumulados.

2.11/ Qualquer atualização dos dados pessoais do Membro (morada, nome, etc.) ou qualquer outra alteração útil dos dados pode ser efetuada diretamente na sua conta pessoal de Membro em www.hotel-bb.com

2.12/ O Membro compromete-se, tanto no âmbito das Noites válidas como no exercício das vantagens obtidas no âmbito do programa, a ter um comportamento que não seja contrário aos bons costumes ou à ordem pública, e a não praticar atos de vandalismo, degradação ou perturbação neste âmbito. 
 

3/ Direito de retratação

3.1/ De acordo com as disposições legais em vigor, quando o Membro subscreve o programa B&B HOTELS CLUB no site www.hotel-bb.com ou na aplicação móvel dos B&B HOTELS, tem o direito de rescindir o presente contrato sem ter de fornecer um motivo num prazo de catorze dias.
O prazo de retratação expira catorze dias após o dia da conclusão do contrato. 

3.2./ Para exercer o seu direito de retratação, o Membro deve notificar os B&B HOTELS SAS – 271, rue du Géneral Paulet – 29200, Brest - da sua decisão de retratação do presente contrato através de uma declaração desprovida de ambiguidade (por exemplo, uma carta enviada pelo correio, fax ou correio eletrónico). O Membro pode utilizar o modelo de formulário de retratação reproduzido no anexo 1 das presentes condições gerais, mas não é obrigatório.
Para que o prazo de retratação seja respeitado, basta que o Membro transmita a sua comunicação relativa ao exercício do direito de retratação antes do término do prazo de retratação.

3.3./ Em caso de retratação do presente contrato, os B&B HOTELS reembolsarão todos os pagamentos recebidos do Membro a título de subscrição no programa de fidelização sem atraso excessivo e, em qualquer caso, o mais tardar catorze dias a contar do dia em que os B&B HOTELS forem informados da decisão de retratação do presente contrato. Os B&B HOTELS irão proceder ao reembolso utilizando o mesmo meio de pagamento que tenha sido utilizado para a transação inicial, salvo se as partes anuírem expressamente num meio de pagamento diferente. Em qualquer caso, este reembolso não terá custos para o Membro. 
 

4/ Alteração/Cessação/Substituição do programa

4.1/ Os B&B HOTELS reservam-se o direito de alterar as caraterísticas do programa devido a restrições técnicas, jurídicas ou operacionais. Tal alteração será notificada ao Membro através de um e-mail enviado para o último endereço eletrónico indicado pelo Membro com um pré-aviso de pelo menos trinta (30) dias antes da entrada em vigor da alteração. Em caso de desacordo com a alteração prevista, o Membro pode inscrever-se no programa informando os B&B HOTELS da sua decisão nos trinta dias (30) seguintes à data de receção da comunicação dos B&B HOTELS. Em caso de cancelamento da inscrição, o Membro beneficiará de um reembolso da sua quota anual prorata temporis do período de validade restante a contar da data do cancelamento da inscrição. 

4.2/ Os B&B HOTELS podem também terminar o programa B&B HOTELS CLUB ou substituí-lo por outro programa. Qualquer cessação ou substituição do programa de fidelização será notificada ao Membro através de um e-mail enviado para o último endereço eletrónico indicado pelo Membro com um pré-aviso de pelo menos seis (6) meses antes da data de cessação ou da substituição do programa de fidelização.  No caso de cessação do programa ou de recusa pelo Membro em subscrever novamente o programa de fidelização, o Membro beneficiará de um reembolso da sua quota anual prorata temporis do período restante a contar da data de cessação do programa ou da entrada em vigor do novo programa. A recusa do Membro em subscrever novamente o programa de fidelização deverá ser notificada aos B&B HOTELS por escrito pelo menos trinta (30) dias antes da data de entrada em vigor do novo programa. Em caso de cessação do programa, um prazo de pelo menos trinta (30) dias será, além disso, concedido ao Membro a contar da data de cessação do programa para prevalecer o benefício dos pontos acumulados até àquela data.
 

5/ Rescisão

5.1/ Os Membros podem, a qualquer momento e a seu critério, cancelar a inscrição no programa B&B HOTELS CLUB por carta registada com aviso de receção, respeitando o pré-aviso de pelo menos trinta (30) dias. Nesta situação, a rescisão antecipada das presentes condições não dá direito a um reembolso ou a outra indemnização pelo período restante até ao término inicialmente previsto. 

5.2/ Os B&B HOTELS têm o pleno direito de rescindir com um pré-aviso de trinta (30) dias o presente contrato e a adesão ao programa B&B HOTELS CLUB, sem nenhuma indemnização de qualquer tipo em caso de:
- o Membro não respeitar as estipulações e vantagens das presentes condições gerais;
- utilização abusiva ou fraudulenta das vantagens deste programa;
- falsificação das informações transmitidas aos B&B HOTELS.
Os B&B HOTELS reservam-se o direito de recusar a reinscrição de um Membro que foi excluído durante dois (2) anos.

5.3/ Os B&B HOTELS reservam-se o direito de efetuar, a qualquer momento, verificações relativamente à utilização do programa B&B HOTELS CLUB e ao respeito das regras das presentes condições gerais. No caso de uma rescisão do contrato por iniciativa dos B&B HOTELS nas hipóteses descritas no artigo 5.2, todos os pontos acumulados pelo Membro serão perdidos.
 

6/ Funcionamento do programa

6.1/ Validade das vantagens do programa

As vantagens descritas no ponto 6.2) destas condições gerias são válidas nos hotéis B&B dos países participantes. Para beneficiar destas vantagens, o Membro deve fornecer, na receção do hotel, o seu nome e o seu e-mail ou o seu número de identificação. Na Internet, o Membro deve aceder à sua conta pessoal para beneficiar destas vantagens.
As vantagens só são válidas para as estadias reservadas no balcão dos hotéis B&B, nos sites ou na aplicação móvel dos B&B Hotels, por telefone ou por e-mail diretamente no hotel, para os hotéis B&B dos países participantes. Todas as estadias reservadas através de um intermediário, de um revendedor, de um operador turístico ou de uma agência de viagens terceira (como a Expedia.com, booking.com, etc.) não beneficiarão das vantagens do programa.
Todos os quartos pagos no balcão automático da receção sem uma reserva prévia com o número de identificação do Membro não beneficiarão das vantagens do programa B&B HOTELS CLUB.

6.2/ As vantagens do programa

Todas as subscrições no programa de fidelização dão direito às vantagens seguintes: 
- 10% de desconto nos preços dos quartos (salvo preços promocionais) e do pequeno-almoço, em vigor no momento da reserva, durante todo o ano, sete dias por semana. Este desconto é aplicável desde a chegada ao hotel reservado e não pode ser acumulado com outros preços especiais, ofertas especiais e/ou promoções ou descontos sazonais.
- 5% de desconto sobre o preço reduzido dos quartos e 10% de desconto no pequeno-almoço em vigor no momento da reserva, durante todo o ano, sete dias por semana. Este desconto é aplicável desde a chegada ao hotel reservado.
- Um espaço dedicado no site www.hotel-bb.com, acessível com um e-mail e uma palavra-passe.
- Acumulação de pontos para cada estadia efetuada através de uma reserva direta, que vão permitir beneficiar de vouchers que poderão ser trocados por noites oferecidas até ao valor de 60 € e/ou pequenos-almoços gratuitos.
- Em França, uma linha de assistência especial para gerir as reservas dos Membros dos B&B HOTELS CLUB.

6.3/ Acumulação de pontos

O Membro ganha 100 pontos por cada Noite válida, por um quarto, com a exceção dos quartos pagos com voucher. Se o Membro reservar dois ou mais quartos para a mesma noite, os pontos são apenas acumulados para o quarto por ele ocupado.
O saldo pessoal de pontos pode ser consultado pelo Membro na sua conta pessoal online, acessível através do seu e-mail e palavra-passe.
Os dados de acesso à conta, bem como os pontos acumulados, não podem ser, em caso algum, transferidos, cedidos ou combinados com as contas de outros Membros.
Os pontos acumulados não podem ser, em caso algum, convertidos em dinheiro nem dão direito a qualquer reembolso.

6.4/ Validade dos pontos

Os pontos creditados na conta do Membro são válidos até 30 dias após a data de término da inscrição. Se o Membro não renovar a sua inscrição no programa nesses 30 dias, os pontos não convertidos serão definitivamente perdidos. Contudo, os Membros têm o direito de renovar a sua inscrição até 30 dias após a data de término. Neste caso, os pontos serão considerados como válidos e adicionados a futuros pontos até à próxima data de término da adesão ao programa de fidelização B&B HOTELS CLUB.

6.5/ Conversão de pontos

Quando o Membro acumular trezentos (300) pontos, existe a possibilidade de beneficiar de um voucher para um pequeno-almoço gratuito em qualquer hotel situado num país participante.
Quando o Membro acumular cinquenta (500) pontos, existe a possibilidade de beneficiar de um voucher para dois pequenos-almoços gratuitos em qualquer hotel situado num país participante.
Quando o Membro acumular mil (1000) pontos, tem a possibilidade de beneficiar de um voucher para uma noite, com ou sem pequeno-almoço, no valor máximo de 60 €, em qualquer hotel situado num país participante.
O Membro pode utilizar o seu voucher para uma noite oferecida até ao valor de 60 € para uma reserva de quarto (com ou sem pequeno-almoço), cujo preço seja superior a 60 €, e pagar a diferença entre o preço total da reserva do quarto e o montante do voucher.
A validade dos vouchers depende da disponibilidade dos quartos de hotel. Os vouchers podem ser cedidos a terceiros. As estadias oferecidas até ao valor de 60 € não dão direito a pontos.
Uma vez que tenha acumulado o número mínimo de pontos necessários, o Membro pode convertê-los num voucher, ao aceder à sua conta pessoal online quando desejar. O seu voucher ficará então disponível na sua conta pessoal online.

Um voucher não pode ser utilizado para uma reserva online no próprio dia. Pode, no entanto, ser apresentado diretamente no hotel.

Os vouchers são válidos durante 12 meses a contar da data de emissão. O Membro pode utilizar o seu voucher de duas formas: online, ao introduzir o número do voucher quando validar o seu cesto ou ao apresentá-lo no balcão do hotel.
Quando a reserva efetuada com um voucher tiver sido confirmada (online ou depois de ter sido introduzida no sistema eletrónico de reservas pelo pessoal na receção do hotel), o voucher é considerado como utilizado. Não pode ser reembolsado ou reemitido, mesmo que a estadia tenha sido cancelada.
 

7/ Propriedade dos dados

As informações disponíveis através do programa B&B HOTELS CLUB são da exclusiva propriedade dos B&B HOTELS e das filiais do grupo B&B HOTELS.
O Membro compromete-se a utilizar as informações que recebeu no programa B&B HOTELS CLUB exclusivamente para as suas próprias necessidades e a não as utilizar para fins comerciais.
O Membro não pode reproduzir e difundir, nem que seja gratuitamente, as informações e os dados recolhidos no âmbito do programa B&B HOTELS CLUB.
 

8/ Proteção dos dados pessoais

Os B&B HOTELS processarão os dados pessoais transmitidos diretamente pelos Membros enquanto responsáveis pelo tratamento de dados segundo a legislação aplicável em matéria de proteção de dados pessoais. Os dados pessoais do Membro serão utilizados mais especificamente para as seguintes finalidades:
-     Para gerir o programa e processar o pedido de adesão
-    Para receber comunicações eletrónicas relativas ao funcionamento e aos serviços oferecidos pelo programa (mensagens informativas, saldo de pontos, etc.). 
As finalidades mencionadas anteriormente sobre os dados pessoais são necessárias e têm como base jurídica os direitos e as obrigações que decorrem do presente contrato. 
Os dados pessoais dos Membros processados pelos B&B HOTELS podem ser transferidos para os hotéis dos países participantes, de modo a permitir que os Membros beneficiem das suas vantagens.  
Os dados pessoais dos Membros podem também ser processados por fornecedores terceiros dos B&B HOTELS que gerem os sistemas informáticos e os portais dos B&B HOTELS. Estes fornecedores estão sujeitos a obrigações de segurança e à confidencialidade segundo as leis de proteção de dados. 
Sujeito ao consentimento explícito e específico do Membro, os seus dados pessoais podem também ser utilizados pelos B&B HOTELS e pelos seus parceiros para fins de prospeção comercial. Este consentimento pode ser revogado pelo Membro a qualquer momento, ao contactar os B&B HOTELS através dos dados seguintes. 
Os dados pessoais dos Membros são mantidos durante toda a duração da inscrição. Contudo, os dados poderão ser mantidos em arquivos temporários, antes de serem eliminados, durante toda a duração do prazo de prescrição aplicável a qualquer litígio relativo ao presente contrato. 
Os dados pessoais processados não podem ser transferidos para fora da União Europeia ou para países que não sejam reconhecidos como oferecendo garantias suficientes ao abrigo de uma decisão de adequação da Comissão Europeia. 
Os Membros têm o direito de aceder aos seus dados pessoais mantidos pelos B&B HOTELS e pedir que dados errados, incompletos ou obsoletos sejam retificados, atualizados ou eliminados. Podem também opor-se ao processamento destes dados e têm o direito de fazer valer os seus motivos legítimos para um tal pedido. Os Membros podem também pedir a portabilidade dos seus dados pessoais. 
Os Membros podem também dar instruções específicas ou gerais relativamente a certas formas de processamento dos dados, tendo em vista a manutenção, eliminação e divulgação dos seus dados pessoais depois do seu falecimento. Podem alterar ou cancelar estas instruções a qualquer momento. As instruções específicas podem ficar registadas nos B&B HOTELS. 
•    o direito de acesso significa que as pessoas visadas pelos processamentos de dados pessoais podem perguntar, a qualquer momento, se os seus dados pessoais são processados pelos B&B HOTELS e, se for esse o caso, quais os dados pessoais que são utilizados e de que forma.
•    o direito de retificação significa que as pessoas visadas pelos processamento de dados pessoais podem pedir que os seus dados pessoais mantidos pelos B&B HOTELS sejam retificados se se revelarem incorretos. As pessoas visadas podem também pedir que os seus dados pessoais, se estiverem incompletos, sejam completados, na medida em que isso seja pertinente para a finalidade do processamento efetuado.
•    o direito à eliminação significa que as pessoas visadas pelos processamentos de dados pessoais podem pedir que os seus dados pessoais sejam eliminados, especialmente quando (i) a sua manutenção não seja mais necessária relativamente às finalidades para as quais eles foram recolhidos, (ii) os seus dados pessoais são processados com base no seu consentimento e as pessoas visadas desejem revogar esse consentimento e não exista nenhuma outra base jurídica suscetível de justificar a continuação do processamento de dados, (iii) as pessoas visadas se oponham ao processamento dos seus dados pessoais e desejem, por conseguinte, que estes sejam eliminados, (iv) os seus dados pessoais tenham sido processados de forma ilícita, (v) os seus dados pessoais devem ser eliminados para respeitar uma obrigação legal em virtude do direito europeu ou francês.
•   o direito a limitar o processamento significa que as pessoas visadas pelos processamentos dos dados pessoais podem pedir a imposição de uma limitação do processamento dos seus dados pessoais (i) quando contestarem a exatidão dos seus dados pessoais, durante todo período necessário para verificar a exatidão desses dados, (ii) se, no seguimento de qualquer processamento julgado como não conforme, a pessoa visada preferir limitar o processamento em vez de optar pela supressão total dos seus dados pessoais, (iii) se os seus dados pessoais já não forem necessários para fins de processamento, mas a sua manutenção pelos B&B HOTELS ainda for necessária para as pessoas visadas para o reconhecimento, exercício ou defesa dos seus direitos em tribunal, (iv) quando elas se opuserem ao processamento dos dados pessoais e desejem limitar o seu processamento durante o período necessário para verificar se o fundamento legítimo invocado é justificado.
•   o direito de se opor ao processamento significa que as pessoas visadas pelos processamentos dos dados pessoais podem contestar o processamento dos seus dados pessoais. O direito de se opor ao processamento dos dados pessoais só pode ser exercido evocando motivos legítimos relativos à sua situação particular. Será posto termo ao tratamento litigioso, salvo se existirem razões legítimas e imperiosas que justifiquem a sua continuação segundo as regras e regulamentos aplicáveis. 
•    O direito à portabilidade dos dados significa que as pessoas visadas pelos processamentos dos dados pessoais podem exigir, nas condições fixadas pelas leis de proteção de dados, a receção dos seus dados pessoais num formato estruturado, normalmente utilizado e legível por uma máquina, ou exigir que os B&B HOTELS os transmitam diretamente a uma parte terceira da sua escolha quando isso for legal e tecnicamente possível.
A fim de exercerem os seus direitos, os Membros devem dirigir-se aos B&B HOTELS da seguinte forma, fornecendo uma prova da sua identidade:

Ao inscrever-se no programa B&B HOTELS CLUB, o Membro aceita as presentes condições gerais.

Purpose

B&B Hotels offers its guests the opportunity to participate in the B&B HOTELS Group loyalty program. Within the framework of this program, hotel accommodation can be booked at a discount on the basis of the following terms and conditions, and points can be collected and redeemed for accommodation and/or breakfast vouchers at a B&B HOTELS in Germany, France, Italy, Spain, Belgium, Switzerland (except Lully 3 Lakes Hotel), Austria, Hungary and Portugal (participating countries). These general terms and conditions of the B&B HOTELS CLUB set out the general contractual conditions which constitute the contractual basis for participation in the B&B HOTELS Club program.

1. Definitions

Guest: person who books a room in a B&B Hotel

Member: any guest who accepts the B&B Hotels CLUB program terms and conditions upon registration, has received a confirmation notice and has paid the annual fee

Valid night: overnight stay in a B&B hotel that entitles the guest to earn points according to the terms and conditions of these General Terms and Conditions. Only nights of a Member booked through the Direct Channel will be considered valid.

Direct Channel: Booking at the front desk of a B&B Hotel on site, via the B&B Hotels website or mobile app, by phone or by email directly with the hotel. Any bookings made through a reseller, tour operator or third-party travel agency (such as expedia.com, booking.com, etc.) are not direct channels and do not qualify to earn points.

Point: unit of measurement that can be collected as credit for a valid night at a B&B hotel.
 

2. CConditions of participation in the program

2.1 / This program is reserved for guests of B&B Hotels who have become members of the Club Program by confirming these Terms of Participation and have paid the annual fee.

The Guest may join the Program in the following ways:

  • on the Internet at www.hotel-bb.com
  • via the B&B Hotels mobile app
  • at B&B Hotels in participating countries

2.2 / All persons who have reached the age of majority or legal capacity under the laws of their country may participate in the B&B HOTELS CLUB Program. When registering, all required mandatory fields must be filled in truthfully and completely. To participate in the B&B Club program, the member must provide a valid personal e-mail address. The same e-mail address cannot be used by two members.

2.3 / Participation in the B&B HOTELS CLUB program is subject to an annual fee (hereinafter "Annual Fee").

2.4 / The member will receive an e-mail with a personal identification number at the beginning of the membership. A physical B&B HOTELS CLUB card shall not be issued. The identification number is to be treated confidentially and is only valid for the respective Member. The membership cannot be sold nor is it transferable to third parties. The discounts and benefits of the program are personal and also not transferable to third parties. They can only be used for the member's own stays in a B&B hotel. Notwithstanding the foregoing, the generated accommodation vouchers may be passed on to third parties free of charge, but the resale of accommodation vouchers to third parties is expressly prohibited. Each member can only conclude one membership.

2.5 / The member can access his/her membership account on the Internet at www.hotel-bb.com. The overview of overnight stays in a B&B hotel and the points accumulated with the overnight stays shall be deemed to be correct and complete unless the Member raises an objection within four weeks of the last day of the last stay. The overview shall be updated within 5 working days after the last day of a Member's last stay in a B&B hotel under the B&B HOTELS CLUB program.

2.6 / During his/her participation in the B&B HOTELS CLUB program, the Member shall keep his/her access data and in particular the password confidential in order to prevent misuse by third parties. Passing on the password is not permitted.

2.7 / Changes to the e-mail address, postal address or other details may be made by the Member directly in his/her Club program profile on the Internet site www.hotelbb.com. The Member shall be entitled to make any necessary changes. Notwithstanding the foregoing, however, B&B Hotels GmbH must be notified immediately in text form (e.g. by e-mail or by means of an online contact form) of any changes to the Member's name details.

2.8 / The subscription shall be valid for one year from the date of confirmation of membership by B&B Hotels (i.e. a subscription dated June 15, 2020 shall be valid until June 14, 2021). One month before the expiration of the membership, the member will receive a request for renewal. If the membership is not renewed by the member within this period, it will expire. In order not to lose accumulated points, the Member has thirty days after the expiry of the subscription to generate accommodation vouchers valid for 12 months from his/her accumulated points, provided that the minimum number of points for conversion indicated below has been reached. After the expiration of this period, the points accumulated until then will be completely forfeited.

2.9 / The Member may contact Customer Service at any time through thecontact form(https://www.hotel-bb.com/en/help-contact/contact-form/germany) for assistance in the correct execution of the B&B HOTELS CLUB program and for information on the accumulated points.

2.10 / All personal data of the Member (address, name, etc.) and other useful data changes can be updated directly through the personal account at www.hotelbb.com.

2.11 / Consent to receive newsletters and other information.

By registering for the B&B HOTELS CLUB program, the Member (the User) agrees, as a contractual consideration, to receive advertising (electronic communications relating to the operations and services offered by the program (general information messages, personalized information such as score, overview of bookings, etc., as well as offers, etc.).

By joining the B&B HOTELS CLUB Program, the Member agrees, as contractual consideration, that B&B HOTELS GmbH may use his/her personal data, in addition to the collection, processing and use required for the implementation of the B&B HOTELS CLUB Program in the context of bookings, to send regular information on group-wide news, promotions and offers from B&B Hotels on the subject of hotels and travel by e-mail, SMS, WhatsApp or other electronic media.

Furthermore, the member agrees as contractual consideration that his/her personal data may be passed on within the B&B Hotels Group and may also be used for the targeted placement of advertisements on the B&B Hotels websites as well as on social media platforms.

The member may revoke this consent at any time using the aforementioned contact details.
 

3.Terms of payment

B&B Hotels accepts the following credit cards: Visa, Mastercard and American Express. Other means of payment are only permitted with the consent of B&B Hotels.
 

4.Cancellation Policy

If you have joined the B&B HOTELS CLUB program on the internet at www.hotelbb.com or via the B&B Hotels mobile APP, you have the right to revoke this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day you registered for the B&B HOTELS CLUB program. To exercise your right of withdrawal, you must notify us, the:

by means of a clear declaration (e.g. a letter sent by mail, fax or e-mail) about your decision to revoke this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the revocation

If you revoke this contract, we shall reimburse you all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

5.Modification of the program; changes to the conditions of participation.

5.1 / B&B Hotels may modify, discontinue or install certain functions of the Service due to technical developments or for practical, technical, legal, financial and security reasons, in each case informing the Member by e-mail of adjustments relevant to the use of the Program.

5.2 / These changes will take effect thirty days after notification to the members. In case of disagreement about the new terms and conditions, the Member may withdraw from the contract by informing B&B Hotels within 10 days after receiving the notification. B&B Hotels may terminate the B&B HOTELS CLUB program upon six months' notice and at its sole discretion, or replace it with a comparable program. In the event of termination of the program, Members shall be granted a period of at least 30 days after the end of the program to use any accrued rewards.

5.3 / B&B Hotels shall be entitled to assign or transfer the rights and obligations to another legal entity. This is subject to the condition that the rights to which the Member is entitled under these Terms and Conditions are not forfeited or restricted.

5.4./ B&B Hotels further reserves the right to amend or supplement these Terms and Conditions of Participation in whole or in part at any time, insofar as this is necessary in the interest of simple and secure processing and, in particular, to prevent abuse. In the event of such amendments, the interests of the members shall be given due consideration. Insofar as changes significantly affect the rights and obligations of the member, the member will be notified of these in text form via the last known e-mail address before the changes come into force. An amendment and the new Terms and Conditions of Participation shall be deemed to have been approved if the member does not give notice of termination within one month of the date of dispatch of the notification pursuant to Section 5, or if the member uses his/her own identification number to obtain a points credit after this period has expired. The member will be informed of this separately in the notification.

5.5./Changes to the B&B Club program benefits
 

It is expressly stated that the B&B Club Program benefits specified in Section 7.2 may also be changed or cancelled in whole or in part at any time in accordance with Section 4.

6/ Conditions for termination of the subscription

6.1 / During the term of the membership, termination is only possible for both parties for good cause.

6.2 / Termination by B&B Hotels Germany GmbH

B&B Hotels Germany GmbH shall be entitled to terminate the membership for good cause without notice or compensation for the remaining period until the original end of the contract.

6.3 / B&B Hotels shall have the right to extraordinary termination without notice in particular in the following cases:

  • breach by the member of these terms and conditions of participation or the general terms and conditions of business
  • misuse or fraudulent use of the benefits of this program;
  • any provision of false information to B&B Hotels Germany GmbH;
  • any inappropriate or criminal behavior (especially insulting or physical behavior towards hotel employees or guests); B&B HOTELS Germany GmbH reserves the right to further rights and measures in such a case
  • non-compliance with legal regulations
  • impairment of the further interests of B&B Hotels (in particular violation of the currently valid house rules of a participating hotel, in the case of issuing a house ban to the member in one or more B&B Hotels)
  • discontinuation of the program
  • resale of vouchers

B&B Hotels reserves the right to conduct any type of review at any time regarding the use of the B&B HOTELS CLUB program and compliance with the provisions in this agreement.

6.4 Legal consequences of termination

Termination of membership shall result in complete withdrawal from the B&B Club program. In the event of termination of the Agreement due to the Member's breach of these Terms and Conditions, all of the Member's points accumulated up to the date of termination shall be lost.

B&B Hotels GmbH may refuse to allow excluded members to participate in the B&B HOTELS Club program again for a period of 2 years.
 

7. Functions of the program

7.1 / Validity of the benefits of the program

The following benefits are valid in B&B hotels in the participating countries. In order to benefit from these advantages, the Member must provide his/her name and email address or identification number at the hotel reception. Online, the member must use his/her personal account.

The benefits are only valid for bookings made, at the reception of a B&B hotel on site, via the B&B Hotels website or mobile app, as well as by phone or email directly with the hotel. All bookings made through a reseller, tour operator or third party travel agency (such as expedia.com, booking.com, etc.) are not direct channels and are not eligible to earn points.

An overnight stay for which payment is made at the check-in machine without prior booking with the Member's identification number does not entitle the Member to earn points.

7.2 / The advantages of the program

  • 10% discount on the room rate and breakfast rate, valid at the time of booking, all year round, seven days a week. This discount cannot be combined with special rates, special offers and / or promotions or other discounts.
  • In case of already existing special prices, special offers and / or promotions or other discounts, a 5% discount on the promotion room price and a 10% discount on the breakfast price, valid at the time of booking, all year round, seven days a week.
  • Special section on the website www.hotel-bb.com, accessible via email and password.
  • Crediting of points, for each overnight stay booked directly. The accumulated points can be converted into accommodation or breakfast vouchers.

7.3 / Amount of the points credit

The member receives 100 points for each overnight stay that the member has personally booked and used. No points will be credited for overnight stays that have been paid for in whole or in part with a voucher or that the Member has booked for a third person.

The collected points are not transferable and cannot be combined with the collected points of other members.

The payment of the collected points in EURO is excluded.

7.4 / Validity of the points

The points collected on the membership account are valid until 30 days after the expiration of the membership. If the member does not renew his/her membership for the program within 30 days, the remaining points are automatically lost. In case of timely renewal of the membership, the points accumulated so far will be automatically transferred.

7.5 / Conversion of points

Once the Member has accumulated 300 (three hundred) points, he/she will have the opportunity to receive a voucher for a free breakfast at any hotel in the participating countries.

Once the member has earned 500 (five hundred) points, he/she will have the opportunity to receive a voucher for two free breakfasts at any hotel in the participating countries.

Once the member has earned 1000 (one thousand) points, he/she will have the opportunity to receive a voucher for one night's accommodation with or without breakfast with a maximum value of €60 in any hotel in the participating countries.

Once he/she has reached the minimum number of points required, the member can convert his/her points into vouchers via his/her personal online account. The voucher is then available on the personal online account.

7.6 / Redemption of the vouchers

The member can redeem the vouchers in each case when booking at the respective B&B hotel.

Overnight vouchers (with or without breakfast) have a maximum value of 60 €. If the room rate is higher than this amount, the voucher can still be used, the difference between the total price of the booking and the amount of the voucher must then be paid by the member.

The use of the vouchers is subject to the availability of hotel rooms in the respective B&B hotel.

The vouchers may be passed on to third parties. Resale of the vouchers is not permitted.

No points can be collected for free nights with breakfast up to a value of €60.

The vouchers are valid for 12 months from the date of issue. The member can redeem his voucher either online by entering the respective voucher number or in person by showing it at the hotel counter.

Once the voucher booking is confirmed (online or when the booking is entered into the electronic reservation system by hotel staff at the hotel reception), the voucher is considered used.

If the stay is cancelled and the voucher redemption has not taken place, the guest must contact the service team via the contact form.

When redeeming a voucher, online check-in or check-in directly at the vending machine in the hotel is not possible.

Currently, only one voucher per overnight stay is possible online. If several vouchers are redeemed for a longer stay, the guest must contact the hotel directly.
 

8./ Liability

The member must use and treat his/her B&B HOTELS CLUB identification number and the associated password confidentially.

B&B Hotels Germany GmbH shall only be liable for damages incurred by the participant in connection with membership in the B&B Club program in the event of intent or gross negligence. Any compensation for damages shall be limited to the amount of the typically foreseeable damage. The above limitation of liability shall not apply in the event of injury to life, limb or health, in the event of claims under the Product Liability Act and to the extent that the law prohibits such limitations.

The Member acknowledges that B&B Hotels has fulfilled its obligations with respect to the essential features and modalities of the IT system used to support the B&B HOTELS CLUB program.
 

9./ Ownership and confidentiality

The information available under the B&B HOTELS CLUB program shall remain the exclusive property of B&B Hotels and sister companies of the B&B Hotels Group.

The Member undertakes to use the information that becomes known to him/her in the B&B HOTELS CLUB program exclusively for private purposes.

The Member may not reproduce information and data found through the B&B HOTELS CLUB program himself/herself, nor may he/she distribute it free of charge.
 

10./ Protection of personal data

B&B Hotels GmbH, as data controller within the meaning of the applicable data protection laws, processes personal data provided directly by members. The personal data is processed in particular for the following purposes:

  • To administer the program and process the membership application.
  • To receive electronic communications related to the operations and services offered by the Program (information messages, score, etc.).

These aforementioned purposes of data processing are necessary and have as their legal basis the fulfillment of the rights and obligations arising from this present contract (Art. 6 para.1 lit.b DSGVO).

Personal data of members processed by B&B Hotels Germany GmbH may be transferred to hotels in participating countries to enable the member to use their benefits.

Personal data of members may also be processed by B&B Hotels Germany GmbH's third party contractors that manage B&B Hotels Germany GmbH's information technology systems and portals. These contractors are subject to security and data protection obligations in accordance with applicable data protection laws.

Furthermore, on the basis of this consent, members' personal data may also be used by B&B Hotels Germany GmbH and its partners for commercial purposes and market research. This consent may be revoked by the member at any time with future effect by contacting B&B Hotels Germany GmbH using the contact details provided below.

Members' personal data will be stored for the duration of their membership.

After termination of a contractual relationship, personal data will be stored as long as the responsible party is legally obliged to do so, Art. 17 DSGVO. This regularly results from legal obligations to provide proof and to store data from commercial and tax law. After the purpose has ceased to exist or these periods have expired, the data is routinely blocked or deleted in accordance with the legal requirements.

The personal data processed will not be transferred outside the European Union or to countries other than those recognized as having adequate security measures in place.

Data subjects may request information about the data stored about them at the above address. In addition, they may, under certain conditions, request the correction or deletion of their data. Furthermore, they have the right to restrict the processing of the data as well as the right to receive the provided data in a structured, common and machine-readable format. Furthermore, if they have given their consent, they have the right to revoke it. They have the possibility to lodge a complaint with the data protection officer or a supervisory authority if they believe that the processing of personal data concerning them violates the GDPR.

Members may also provide specific or general instructions regarding certain forms of data processing in order to preserve, delete and disclose their personal data after their death. You may change or cancel these instructions at any time. The specific instructions can be deposited with B&B Hotels.

Pursuant to Art. 21 (1) DSGVO, the data processing may be objected to on grounds relating to the particular situation of the data subject at the above address. The data subject has the right to object, without giving reasons, to processing of his/her personal data for direct marketing purposes. If the controller processes the data to protect legitimate interests, they may object to such processing on grounds relating to their particular situation. The controller shall then no longer process such personal data, unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms concerned, or for the establishment, exercise or defense of legal claims.

11.Agreement to the general terms and conditions and applicable law

By registering for the B&B HOTELS CLUB program, the member unconditionally agrees to these terms and conditions of participation as well as the general terms and conditions of the participating hotels for all future bookings as a member. The above Terms and Conditions of Participation supersede all prior agreements and are governed by German law, without prejudice to any mandatory protective provisions that may apply in the consumer's country of residence. The place of performance is Hochheim.

The European Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at https://www.ec.europa.eu/consumers/odr. B&B Hotels Germany GmbH is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

2.8/ The subscription shall be valid for one year from the date of confirmation of membership by B&B Hotels (i.e. a subscription dated June 15, 2020 shall be valid until June 14, 2021). One month before the expiration of the membership, the member will receive a request for renewal. If the membership is not renewed by the member within this period, it will expire. In order not to lose accumulated points, the Member has thirty days after the expiry of the subscription to generate accommodation vouchers valid for 12 months from his/her accumulated points, provided that the minimum number of points for conversion indicated below has been reached. After the expiration of this period, the points accumulated until then will be completely forfeited.

2.9/ The Member may contact Customer Service at any time through the contact form (https://www.hotel-bb.com/en/help-contact/contact/germany) for assistance in the correct execution of the B&B HOTELS CLUB program and for information on the accumulated points.

2.10/ All personal data of the Member (address, name, etc.) and other useful data changes can be updated directly through the personal account at www.hotel-bb.com.

2.11/ Consent to receive newsletters and other information

By registering for the B&B HOTELS CLUB program, the Member (the User) agrees, as a contractual consideration, to receive advertising (electronic communications relating to the operations and services offered by the program (general information messages, personalized information such as score, overview of bookings, etc., as well as offers, etc.).

By joining the B&B HOTELS CLUB Program, the Member agrees, as contractual consideration, that B&B HOTELS GmbH may use his/her personal data, in addition to the collection, processing and use required for the implementation of the B&B HOTELS CLUB Program in the context of bookings, to send regular information on group-wide news, promotions and offers from B&B Hotels on the subject of hotels and travel by e-mail, SMS, WhatsApp or other electronic media.

Furthermore, the member agrees as contractual consideration that his/her personal data may be passed on within the B&B Hotels Group and may also be used for the targeted placement of advertisements on the B&B Hotels websites as well as on social media platforms.

The member may revoke this consent at any time using the aforementioned contact details.

3/ Terms of payment

B&B Hotels accepts the following credit cards: Visa, Mastercard and American Express. Other means of payment are only permitted with the consent of B&B Hotels.
 

4/ Cancellation policy

 If you have joined the B&B HOTELS CLUB program on the internet at www.hotelbb.com or via the B&B Hotels mobile APP, you have the right to revoke this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day you registered for the B&B HOTELS CLUB program. To exercise your right of withdrawal, you must notify us, the

by means of a clear declaration (e.g. a letter sent by mail, fax or e-mail) about your decision to revoke this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the revocation

If you revoke this contract, we shall reimburse you all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

5/ Modification of the program; changes to the conditions of participation.

5.1/ B&B Hotels may modify, discontinue or install certain functions of the Service due to technical developments or for practical, technical, legal, financial and security reasons, in each case informing the Member by e-mail of adjustments relevant to the use of the Program.

5.2/ These changes will take effect thirty days after notification to the members. In case of disagreement about the new terms and conditions, the Member may withdraw from the contract by informing B&B Hotels within 10 days after receiving the notification. B&B Hotels may terminate the B&B HOTELS CLUB program upon six months' notice and at its sole discretion, or replace it with a comparable program. In the event of termination of the program, Members shall be granted a period of at least 30 days after the end of the program to use any accrued rewards.

5.3/ B&B Hotels shall be entitled to assign or transfer the rights and obligations to another legal entity. This is subject to the condition that the rights to which the Member is entitled under these Terms and Conditions are not forfeited or restricted.

5.4/ B&B Hotels further reserves the right to amend or supplement these Terms and Conditions of Participation in whole or in part at any time, insofar as this is necessary in the interest of simple and secure processing and, in particular, to prevent abuse. In the event of such amendments, the interests of the members shall be given due consideration. Insofar as changes significantly affect the rights and obligations of the member, the member will be notified of these in text form via the last known e-mail address before the changes come into force. An amendment and the new Terms and Conditions of Participation shall be deemed to have been approved if the member does not give notice of termination within one month of the date of dispatch of the notification pursuant to Section 5, or if the member uses his/her own identification number to obtain a points credit after this period has expired. The member will be informed of this separately in the notification.

5.5/ Changes to the B&B Club program benefits

It is expressly stated that the B&B Club Program benefits specified in Section 7.2 may also be changed or cancelled in whole or in part at any time in accordance with Section 4.

6 / Conditions for termination of the subscription

6.1/ During the term of the membership, termination is only possible for both parties for good cause.

6.2/ Termination by B&B Hotels Austria GmbH

B&B Hotels Austria GmbH shall be entitled to terminate the membership for good cause without notice or compensation for the remaining period until the original end of the contract.

6.3/ B&B Hotels shall have the right to extraordinary termination without notice in particular in the following cases:

  • breach by the member of these terms and conditions of participation or the general terms and conditions of business
  • misuse or fraudulent use of the benefits of this program;
  • any provision of false information to B&B Hotels Austria GmbH;
  • any inappropriate or criminal behavior (especially insulting or physical behavior towards hotel employees or guests); B&B HOTELS Austria GmbH reserves the right to further rights and measures in such a case
  • non-compliance with legal regulations
  • impairment of the further interests of B&B Hotels (in particular violation of the currently valid house rules of a participating hotel, in the case of issuing a house ban to the member in one or more B&B Hotels)
  • discontinuation of the program
  • resale of vouchers

B&B Hotels reserves the right to conduct any type of review at any time regarding the use of the B&B HOTELS CLUB program and compliance with the provisions in this agreement.

6.4 Legal consequences of termination

Termination of membership shall result in complete withdrawal from the B&B Club program. In the event of termination of the Agreement due to the Member's breach of these Terms and Conditions, all of the Member's points accumulated up to the date of termination shall be lost.

B&B Hotels GmbH may refuse to allow excluded members to participate in the B&B HOTELS Club program again for a period of 2 years..
 

7/ Functions of the program

7.1 Validity of the benefits of the program

The following benefits are valid in B&B hotels in the participating countries. In order to benefit from these advantages, the Member must provide his/her name and email address or identification number at the hotel reception. Online, the member must use his/her personal account.

The benefits are only valid for bookings made, at the reception of a B&B hotel on site, via the B&B Hotels website or mobile app, as well as by phone or email directly with the hotel. All bookings made through a reseller, tour operator or third party travel agency (such as expedia.com, booking.com, etc.) are not direct channels and are not eligible to earn points.

An overnight stay for which payment is made at the check-in machine without prior booking with the Member's identification number does not entitle the Member to earn points.

7.2/ The advantages of the program

  • 10% discount on the room rate and breakfast rate, valid at the time of booking, all year round, seven days a week. This discount cannot be combined with special rates, special offers and / or promotions or other discounts.
  • In case of already existing special prices, special offers and / or promotions or other discounts, a 5% discount on the promotion room price and a 10% discount on the breakfast price, valid at the time of booking, all year round, seven days a week.
  • Special section on the website www.hotelbb.com, waccessible via email and password.
  • Crediting of points, for each overnight stay booked directly. The accumulated points can be converted into accommodation or breakfast vouchers.

7.3/ Amount of the points credit

The member receives 100 points for each overnight stay that the member has personally booked and used. No points will be credited for overnight stays that have been paid for in whole or in part with a voucher or that the Member has booked for a third person.

The collected points are not transferable and cannot be combined with the collected points of other members.

The payment of the collected points in EURO is excluded.

7.4/ Validity of the points

The points collected on the membership account are valid until 30 days after the expiration of the membership. If the member does not renew his/her membership for the program within 30 days, the remaining points are automatically lost. In case of timely renewal of the membership, the points accumulated so far will be automatically transferred.

7.5 / Conversion of points

Once the Member has accumulated 300 (three hundred) points, he/she will have the opportunity to receive a voucher for a free breakfast at any hotel in the participating countries.

Once the member has earned 500 (five hundred) points, he/she will have the opportunity to receive a voucher for two free breakfasts at any hotel in the participating countries.

Once the member has earned 1000 (one thousand) points, he/she will have the opportunity to receive a voucher for one night's accommodation with or without breakfast with a maximum value of €60 in any hotel in the participating countries.

Once he/she has reached the minimum number of points required, the member can convert his/her points into vouchers via his/her personal online account. The voucher is then available on the personal online account.

7.6 / Redemption of the vouchers

The member can redeem the vouchers in each case when booking at the respective B&B hotel.

Overnight vouchers (with or without breakfast) have a maximum value of 60 €. If the room rate is higher than this amount, the voucher can still be used, the difference between the total price of the booking and the amount of the voucher must then be paid by the member.

The use of the vouchers is subject to the availability of hotel rooms in the respective B&B hotel.

The vouchers may be passed on to third parties. Resale of the vouchers is not permitted.

No points can be collected for free nights with breakfast up to a value of €60.

The vouchers are valid for 12 months from the date of issue. The member can redeem his voucher either online by entering the respective voucher number or in person by showing it at the hotel counter.

Once the voucher booking is confirmed (online or when the booking is entered into the electronic reservation system by hotel staff at the hotel reception), the voucher is considered used.

If the stay is cancelled and the voucher redemption has not taken place, the guest must contact the service team via the contact form.

When redeeming a voucher, online check-in or check-in directly at the vending machine in the hotel is not possible.

Currently, only one voucher per overnight stay is possible online. If several vouchers are redeemed for a longer stay, the guest must contact the hotel directly.
 

8/ Liability

The member must use and treat his/her B&B HOTELS CLUB identification number and the associated password confidentially.

B&B Hotels Austria GmbH shall only be liable for damages incurred by the participant in connection with membership in the B&B Club program in the event of intent or gross negligence. Any compensation for damages shall be limited to the amount of the typically foreseeable damage. The above limitation of liability shall not apply in the event of injury to life, limb or health, in the event of claims under the Product Liability Act and to the extent that the law prohibits such limitations.

The Member acknowledges that B&B Hotels has fulfilled its obligations with respect to the essential features and modalities of the IT system used to support the B&B HOTELS CLUB program.
 

9/ Ownership and confidentiality

The information available under the B&B HOTELS CLUB program shall remain the exclusive property of B&B Hotels and sister companies of the B&B Hotels Group.

The Member undertakes to use the information that becomes known to him/her in the B&B HOTELS CLUB program exclusively for private purposes.

The Member may not reproduce information and data found through the B&B HOTELS CLUB program himself/herself, nor may he/she distribute it free of charge.

10/ Protection of personal data

B&B Hotels GmbH, as data controller within the meaning of the applicable data protection laws, processes personal data provided directly by members. The personal data is processed in particular for the following purposes:

  • To administer the program and process the membership application.
  • To receive electronic communications related to the operations and services offered by the Program (information messages, score, etc.

These aforementioned purposes of data processing are necessary and have as their legal basis the fulfillment of the rights and obligations arising from this present contract (Art. 6 para.1 lit.b DSGVO).

Personal data of members processed by B&B Hotels Austria GmbH may be transferred to hotels in participating countries to enable the member to use their benefits.

Personal data of members may also be processed by B&B Hotels Austria GmbH's third party contractors that manage B&B Hotels Austria GmbH's information technology systems and portals. These contractors are subject to security and data protection obligations in accordance with applicable data protection laws.

Furthermore, on the basis of this consent, members' personal data may also be used by B&B Hotels Austria GmbH and its partners for commercial purposes and market research. This consent may be revoked by the member at any time with future effect by contacting B&B Hotels Austria GmbH using the contact details provided below.

Members' personal data will be stored for the duration of their membership.

After termination of a contractual relationship, personal data will be stored as long as the responsible party is legally obliged to do so, Art. 17 DSGVO. This regularly results from legal obligations to provide proof and to store data from commercial and tax law. After the purpose has ceased to exist or these periods have expired, the data is routinely blocked or deleted in accordance with the legal requirements.

The personal data processed will not be transferred outside the European Union or to countries other than those recognized as having adequate security measures in place.

Data subjects may request information about the data stored about them at the above address. In addition, they may, under certain conditions, request the correction or deletion of their data. Furthermore, they have the right to restrict the processing of the data as well as the right to receive the provided data in a structured, common and machine-readable format. Furthermore, if they have given their consent, they have the right to revoke it. They have the possibility to lodge a complaint with the data protection officer or a supervisory authority if they believe that the processing of personal data concerning them violates the GDPR.

Members may also provide specific or general instructions regarding certain forms of data processing in order to preserve, delete and disclose their personal data after their death. You may change or cancel these instructions at any time. The specific instructions can be deposited with B&B Hotels.

Pursuant to Art. 21 (1) DSGVO, the data processing may be objected to on grounds relating to the particular situation of the data subject at the above address. The data subject has the right to object, without giving reasons, to processing of his/her personal data for direct marketing purposes. If the controller processes the data to protect legitimate interests, they may object to such processing on grounds relating to their particular situation. The controller shall then no longer process such personal data, unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms concerned, or for the establishment, exercise or defense of legal claims.

11/ Agreement to the general terms and conditions and applicable law

By registering for the B&B HOTELS CLUB program, the member unconditionally agrees to these terms and conditions of participation as well as the general terms and conditions of the participating hotels for all future bookings as a member. The above Terms and Conditions of Participation supersede all prior agreements and are governed by German law, without prejudice to any mandatory protective provisions that may apply in the consumer's country of residence. The place of performance is Hochheim.

The European Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at https://www.ec.europa.eu/consumers/odr. B&B Hotels Austria GmbH is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
