- The purpose of these terms and conditions (hereinafter the "terms and conditions") is to govern the rights and obligations of subscribers to the B&me Club offer (hereinafter the "members") and the following companies:

hereinafter referred to as "B&B HOTELS" or the "company".
- B&B HOTELS provides its members with a customer service accessible by email by sending a request via the Contact Form.
2. Purpose and scope
- These general terms and conditions apply to the conclusion of a contract for the provision of services concluded at a distance, within the framework of the subscription to the B&me Club programme (hereinafter referred to as the "subscription").
- B&B HOTELS offers a subscription to the B&me Club programme to both its business and consumer customers, within the meaning of consumer law, via the website hotel-bb.com (hereinafter the "website") and its mobile application (hereinafter the "application"), which are dedicated to booking hotel services:
- a consumer customer refers to any natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal or agricultural activity;
- a business customer refers to any natural or legal person, public or private, acting for purposes within the scope of their commercial, industrial, craft, liberal or agricultural activity, including when acting on behalf of and for another professional.
- By subscribing to the B&me Club subscription offer, members unreservedly accept these general terms and conditions in accordance with the acceptance procedure set out in Article 4.2 of these general terms and conditions. The company may amend the general terms and conditions. Each new version of the general terms and conditions shall apply to subscriptions or renewals after the date on which they are posted on the website.
3. Subscription eligibility conditions
- To be eligible for membership, members must:
- be at least eighteen (18) years of age and/or have legal capacity;
- be a resident of Luxembourg;
- have a valid personal email address (sharing the same email address between two members is not permitted);
- and have created a B&me account on the website in accordance with the conditions set out in Article 4.1 of these terms and conditions.
Both consumer and professional customers within the meaning of consumer law may subscribe to the subscription.
4. Subscribing to the membership
- Members of the B&me programme can subscribe to the B&me Club subscription via the dedicated section of their B&me personal space on the website www.hotel-bb.com or on the B&B HOTELS mobile app, available in French, English, Portuguese, German, Spanish, Italian, Dutch, Polish, Czech, Slovak, Hungarian and Danish.
4.1 Preliminary step: Creating an account to register
- If they do not already have one, B&B HOTELS customers must create an account in the B&me personal space (hereinafter the "account") enabling them to subscribe to the B&me loyalty programme and access the B&me Club offer of the programme by providing the necessary information. This information must be complete, accurate, not misleading and kept up to date by sending a request via the contact form. B&B HOTELS reserves the right to ask the member to confirm, by any appropriate means, their identity, eligibility and the information provided.
- Members must use their account login details in a personal and confidential manner and keep them secret. Members undertake to protect their login details, including their password, in order to prevent any misuse by third parties.
- Members are solely responsible for the actions carried out on their accounts.
- Under no circumstances shall B&B HOTELS be held liable in the event of identity theft of a member. Any access and actions carried out from a member's account shall be presumed to have been carried out by that member, insofar as B&B HOTELS has no obligation and does not have the technical means to verify the identity of persons accessing the account.
- Any unauthorised connection to a member's account and its consequences are the sole responsibility of the member, who is required to notify B&B HOTELS immediately via the contact form.
4.2 Acceptance of the general terms and conditions
- After creating an account and joining the B&me loyalty programme, B&B HOTELS customers check their order and read through these terms and conditions in full.
- After reading them, they accept these terms and conditions by ticking the box "I accept all the terms and conditions of the B&me Club subscription" in order to subscribe. The terms and conditions in force at the time of subscription are attached to the subscription confirmation email.
4.3 Order confirmation and payment
- B&B HOTELS customers have the opportunity to check the details of their order and the total price and to correct any errors before confirming their acceptance. It is therefore the responsibility of B&B HOTELS customers to check the accuracy of their order before paying the subscription price for the B&me Club offer.
- B&B HOTELS will acknowledge receipt of the subscription to the B&me Club offer by email, to which the general terms and conditions in force at the time of subscription will be attached.
- This confirmation email will also include the member's identification number. This number is strictly personal and associated with the member's name. The subscription cannot be sold or loaned. It is expressly stated that only one subscription per person will be accepted. This subscription is strictly personal. Only the member who has subscribed to it will be able to benefit from the advantages of the programme.
5. Description of the services covered by the subscription
- Subscribing to the membership allows the member to access, on their B&me account, the benefits of the B&me Club programme in addition to the B&me programme, the benefits of which are described below (hereinafter the "programme").
5.1 Conditions of access to B&me CLUB benefits
- The benefits are valid in B&B HOTELS hotels in participating countries: France, Spain, Italy, Germany, Belgium, Switzerland, Hungary, Portugal and Austria. To enjoy these benefits, members must either log in to their account or provide their name and email address or identification number at the hotel reception desk.
- The benefits are only valid for stays booked at a B&B HOTELS hotel in a participating country via the website, by telephone, by email or at the hotel reception (hereinafter referred to as the "direct channel").
- All stays booked through a reseller, tour operator or third-party travel agency (such as Expedia.com, booking.com, etc.) will not be eligible for the programme benefits.
- Any room paid for directly at a hotel reservation terminal, without prior reservation, using the member's identification number, will not benefit from the programme's advantages.
5.2 benefits
5.2.1 discounts
- All subscriptions entitle members to:
- A 10% discount on room rates (excluding promotional rates, private sales offers and special offers) and breakfast, valid at the time of booking, all year round, seven days a week. This discount is applicable upon arrival at the booked hotel and cannot be combined with special rates, special offers and/or promotions or seasonal discounts.
- 5% discount on reduced room rates and 10% discount on breakfast, valid at the time of booking, all year round, seven days a week. This discount is applicable upon arrival at the booked hotel.
Discounts under the B&me Club programme cannot be combined with promotional offers under the B&me loyalty programme (in particular the limited price for booking a room in new participating hotels).
5.2.2 Exchange of accumulated points
5.2.2.1 points accumulation
- A stay at a B&B HOTELS hotel contributes to the collection of B&me Club points, allowing members to enjoy one or more vouchers. Only nights spent by a member who has booked through the direct channel are considered valid (hereinafter "valid nights").
- Members earn one hundred (100) points for each valid night spent (neither cancelled nor refunded) in a room, with the exception of rooms paid for with a voucher. The one hundred (100) points will be credited within seventy-two (72) hours after the end of the stay. If the member books two or more rooms for the same night, points will only be accumulated for the room they occupy. This benefit cannot be combined with special rates, special offers, and/or promotions or seasonal discounts.
- Members can view their points balance in their account. Members also have access to a summary of their accumulated nights at B&B HOTELS in their account. This summary is considered accurate and complete unless the member objects in writing within four (4) weeks of the last date of their stay. The summary is updated within five (5) working days of the member's last day of stay at a B&B HOTELS.
- The account access details and accumulated points may not be transferred, assigned or combined with the accounts of other members under any circumstances.
- Accumulated points cannot be converted into monetary value under any circumstances and do not entitle the member to any refund.
5.2.2.2 Validity period of points
- Points credited to the member's account are valid for up to thirty (30) days after the expiry date of the membership. If the member does not renew their membership within thirty (30) days, any unconverted points will be permanently lost.
- However, members have the right to renew their subscription up to thirty (30) days after the expiry date. In this case, the points will not be lost and will accumulate with future points until the next subscription expiry date.
5.2.2.3 point conversion
- Once members have accumulated the minimum number of points required, they can convert them into vouchers by logging into their account. Their voucher will then be available in their account.
- When members have accumulated three hundred (300) points, they can redeem a voucher for a free breakfast at any B&B HOTELS location in a country participating in B&me CLUB.
- Once a member has accumulated five hundred (500) points, they can receive a voucher for two free breakfasts at any B&B HOTELS located in a country participating in B&me CLUB.
- When Members have accumulated one thousand (1,000) points, they are eligible to receive a voucher worth up to €60 to be used at any B&B HOTELS located in a country participating in B&me CLUB. Only one voucher may be used per room booking.
- Voucher validation is subject to hotel room availability. Stays paid for in full with a voucher do not earn points.
- A voucher cannot be used for a same-day booking on the website. However, it can be used for a booking made directly with the hotel.
- Vouchers are valid for twelve (12) months from their date of issue. Members can use their vouchers in two ways:
- on the website, by entering the voucher number when confirming their basket, or
- by presenting it at the hotel reception desk.
- The voucher is considered used once the booking made with the voucher is confirmed (online or after it has been entered into the electronic booking system by the hotel reception staff) and the check-in procedure is completed upon arrival at the hotel reception.
- The voucher is cancellable and refundable only if the cancellation conditions of the reservation in question so provide.
- By subscribing, members agree to receive electronic communications relating to the operation and services offered by the programme (information messages, points balance, etc.).
5.3 Non-transferable benefits
- With the exception of vouchers, the benefits of the programme are personal and non-transferable.
- Discounts can only be applied to bookings made by the member for their own personal stay.
6. Effective date of the subscription
- The membership contract is concluded and takes effect on the date of acceptance of these terms and conditions and payment of the membership fee (hereinafter the "contract effective date"). From this date, the member benefits from the services covered by the membership contract.
7. Duration of the contract
- The subscription contract is concluded for a renewable term of one (1) year, starting from the effective date of the contract, except in the event of termination by one of the parties under the conditions set out in Article 11 hereof.
- The member may renew the subscription contract within thirty (30) days of the expiry date of the subscription contract.
- In the event of renewal of the subscription contract, the points accumulated under the programme will be retained. However, if the member does not renew the subscription contract within the specified period, the contract will not be tacitly renewed and the remaining points will be permanently lost.
8. Price and payment terms
- The subscription price is thirty-nine (39) euros including all taxes (VAT included) at the rate in force on the date of subscription (hereinafter the "subscription price").
- Any change in the applicable rate may affect the amount of the subscription price.
- Renewal of the subscription contract triggers a new obligation for the member to pay the price in order to continue to benefit from the programme's services for a further period of one (1) year.
- When subscribing, payment is made online by credit card (Visa, Mastercard, American Express).
- When the subscription is renewed, payment is made by direct debit on the contract renewal date using the default credit card on file.
- If the subscription payment by direct debit fails due to a problem with the member's payment method (e.g. expiry of the credit card), the member has 30 days to provide B&B HOTELS customer service with a new valid payment method. Failing this, the subscription contract may be terminated unilaterally by B&B HOTELS.
9. Withdrawal
- In accordance with Article 222-9 et seq. of the Consumer Code, consumer members have a right of withdrawal of fourteen (14) working days from the conclusion of the subscription contract without having to justify their decision or pay a penalty.
- Pursuant to Article 222-9 et seq. of the Consumer Code, consumer members may exercise their right of withdrawal by sending the withdrawal form attached in the appendix to B&B HOTELS customer service using the contact details indicated on this form, or by making a clear statement setting out their decision to withdraw from the contract, using the contact details indicated on the withdrawal form attached in the appendix.
If a member who has not benefited from the advantages of the subscription exercises their right of withdrawal, B&B HOTELS will refund the full amount of the subscription paid within fourteen (14) days of B&B HOTELS receiving the member's request to exercise their right of withdrawal. B&B HOTELS will make the refund using the same means of payment as that used by the member to take out the subscription, unless expressly agreed to make the refund using another means of payment and provided that the refund does not incur any costs for the member. If the consumer member has begun to enjoy the benefits of the subscription during the withdrawal period and subsequently exercises this right, B&B HOTELS shall refund an amount proportional to what has been provided. The provisions of this Article 9 do not apply to non-consumer members.
10. Obligations of members
- When subscribing, each member undertakes not to breach public order, to comply with the laws and regulations in force and to respect the rights of third parties and the provisions of these general terms and conditions.
- In particular, each Member is obliged to:
- behave loyally towards B&B HOTELS;
- be honest and sincere in the information provided to B&B HOTELS;
- use the features of the subscription in accordance with its purpose as described in these terms and conditions;
- not misuse the programme to commit crimes, offences or contraventions punishable under the Criminal Code or any other law;
- respect the privacy of third parties and the confidentiality of exchanges;
- respect the intellectual property rights of B&B HOTELS, particularly with regard to the elements of the programme;
- not modify the information posted online by B&;B HOTELS;
- not to disseminate data that could diminish, disrupt, slow down or interrupt the normal functioning of the programme or the website.
- Members shall refrain from any behaviour contrary to public decency or public order, as well as any act of vandalism, damage or nuisance in connection with the programme benefits obtained through their subscription.
- Members use the programme features accessible on the website and app under their sole and exclusive responsibility.
11. Termination of the subscription
11.1 Termination of membership at the member's initiative
- Members may terminate their subscription before the expiry date of the contract in the event of a breach by B&B HOTELS of its obligation to provide the services covered by the contract within a reasonable period of time. Members may terminate the contract under the conditions described below.
- If B&B HOTELS has not failed to fulfil its obligation to provide the services covered by the contract, you may cancel your subscription at any time, but cancellation does not entitle you to a refund.
- To cancel your subscription, you can go to your B&me account.
11.2 Termination of the subscription by B&B HOTELS
- The subscription may be terminated by B&B HOTELS in the event of a member's failure to comply with their obligations under these terms and conditions, which may result in particular from non-payment of the price, fraudulent behaviour on the part of the member or failure to comply with the programme eligibility conditions set out in Article 3 (lack of legal capacity, etc.).
12. Liability
- B&B HOTELS cannot be held liable if it can demonstrate that the non-performance or poor performance of these general terms and conditions is attributable either to the member, to the of a third party to the contract, or to a case of force majeure, as defined by Luxembourg law and case law.
13. ' personal data protection
B&B HOTELS collects and processes its members' personal data in accordance with the regulations applicable to the protection of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and the Luxembourg law of 1 August 2018 on the protection of natural persons with regard to the processing of personal data.
- In accordance with applicable regulations, members have several rights with regard to their personal data, including the right to access and rectify their personal data. They may also request the restriction of the processing of their data or, where applicable, object to its processing/withdraw their consent.
- Further information on the processing of personal data by B&B HOTELS, as well as on members' rights and how to exercise those rights, can be found in our Privacy Policy.
14. Intellectual property
Nothing herein shall entail any transfer of any kind of property rights, in particular intellectual property rights, over elements belonging to B&B HOTELS to the member, who shall refrain in all circumstances from any action or act likely to infringe, directly or indirectly, the intellectual property rights of B&B HOTELS.
In this regard, it is specified that the content of the website, its general structure, as well as the trademarks, designs, models, animated or non-animated images, texts, photographs, logos, graphic charts, software and programmes, search engines, databases, sounds, videos, domain names, design and all other elements comprising the articles and the website or any other information appearing therein, without this list being exhaustive, are the exclusive property of B&B HOTELS or its partners or third parties who have granted it a licence, and are protected by intellectual property rights that are or will be recognised under the laws in force.
- Any reproduction and/or representation, in whole or in part, of any of these elements without the express authorisation of B&B HOTELS and outside the legal exceptions is prohibited and would constitute, in particular but not exclusively, an infringement punishable under the provisions of the Law of 18 April 2001 on copyright, related rights and databases, as amended.
15. General provisions
- If any clause in these general terms and conditions is deemed unlawful or unenforceable by a court decision, the other provisions shall remain in force.
- The information provided by the hotels-bb.com website shall be deemed authentic between the parties. Elements such as the date and time of receipt or transmission, as well as the quality of the data received, shall be deemed authentic as they appear on the B&B HOTELS information systems, unless the member provides written proof to the contrary. The scope of the evidence provided by the information systems of B&B HOTELS is that granted to an original in the sense of a handwritten, signed paper document.
16. disputes
16.1 With regard to consumer members
These general terms and conditions shall be executed and interpreted in accordance with Luxembourg law. In the event of a dispute, the member shall first contact B&B HOTELS customer service to seek an amicable solution.
Members are reminded that for any information or complaints, B&B HOTELS customer service is available to members by email by sending a request via the contact form.
- In accordance with the provisions of the law of 17 February 2016 introducing out-of-court settlement of consumer disputes into the Consumer Code, members may have recourse, free of charge, to the National Consumer Ombudsman Service, whose contact details are as follows:
Before examining the dispute, the Consumer Mediation Service may refuse to process a complaint under certain conditions (for example, if the complaint is anonymous). Recourse to mediation is only possible if the complaint has not already been the subject of legal action.
- If the parties fail to reach an agreement, the dispute may be brought before the competent court.

16.2 With regard to professional members
- The parties shall endeavour to settle amicably any dispute that may arise between them concerning the interpretation, performance or termination of these general terms and conditions.
- IN THE ABSENCE OF AN AMICABLE AGREEMENT BETWEEN THE PARTIES WITHIN ONE (1) MONTH OF NOTIFICATION OF THE DISPUTE, THE DISPUTE MAY BE SUBMITTED TO THE COMPETENT COURTS OF LUXEMBOURG CITY, TO WHICH EXPRESS AUTHORITY IS EXPRESSLY GIVEN TO SETTLE THE DISPUTE.
