1. Preamble

These general terms and conditions (hereinafter the "General Terms") aim to govern the rights and obligations of members of the B&me program (hereinafter "members") and the following companies:

hereinafter referred to as "B&B HOTELS" or the "Company".

B&B HOTELS provides its members with a customer service accessible by e-mail by sending a request via the Contact Form.

2. Purpose and scope of application

B&B HOTELS offers a B&me loyalty program to its professional and consumer customers, in accordance with consumer law, through the website hotel-bb.com and its mobile application, dedicated to booking hotel services.

Acceptance of these terms and conditions by creating an account in the "B&me" customer area implies the conclusion of an electronic contract entered into freely to join the B&me loyalty program (hereinafter the "program").

By creating a B&me account, members become part of the B&me program and accept these terms and conditions without reservation.

Members are expressly informed that these general terms and conditions do not govern:

the use of the website, which is governed by the Website General Terms of Use, accessible here.
The booking of a stay, which is governed by the general terms and conditions of sale, accessible here.
The paid subscription to the B&me CLUB program, reserved for members who have subscribed to the B&me program, governed by the General Terms and Conditions accessible here.

3. Program eligibility conditions

To join the program, members must:

be at least eighteen (18) years old and/or have legal capacity (B&B HOTELS reserves the right to carry out any checks to ascertain the member's ability to participate in the program).

The program applies to both consumers and professionals as defined by Legislative Decree 6 September 2005, no. 206 Consumer Code.

"consumer client" means a natural person acting for purposes unrelated to their commercial, industrial, craft, liberal or agricultural activity;
"professional client" means any natural or legal person, public or private, acting for purposes related to their commercial, industrial, craft, liberal or agricultural activity, even when acting on behalf of another professional.

B&B HOTELS reserves the right to carry out any checks to ensure the member's ability to participate in the program.

4. Participation in the program

4.1 Program Registration

Membership in the B&me program is free of charge:

by filling out the form and activating an account, available in French, English, Spanish, Portuguese, German and Italian, on the B&B HOTELS website or mobile application.
when booking a room on this website;
directly at the hotel reception.

The information that the member provides to B&B HOTELS when joining the program must be complete, up-to-date, sincere, and in no way misleading.

B&B HOTELS reserves the right to ask the member to confirm, by any appropriate means, their identity, eligibility, and the information provided.

Members are informed and accept that the information entered when joining the program constitutes proof of their identity. The information provided by members is binding as soon as it has been validated.

Consequently, the member undertakes to update this information in their account so that it always corresponds to the above criteria or to inform B&B HOTELS of any changes made via the Contact Form.

Membership is personal and only the program member can benefit from it. The use of the program by persons other than the member is prohibited.

It is expressly stated that the program is entirely digital. Therefore, no physical support (e.g., a loyalty card) will be delivered or sent when joining the program.

4.2 Acceptance of terms and conditions

The member undertakes to carefully read these general terms and conditions before joining the program on the website and expressly accepts them by confirming the account creation.

Joining the program implies acknowledging and accepting the terms and conditions found at the bottom of each page of the website, with the possibility to download them.

5. The benefits of the program

The B&me Program allows customers to benefit from the advantages described here (varying from one country to another).

The benefits of the B&me Program:

are non-transferable;
are non-refundable;
cannot be combined with bookings made using a corporate code;
can only be used when bookings have been made on the Website and the Application.

The member is expressly informed that the benefits offered by the B&me program are subject to change and will be informed of any definitive termination of the B&me Program by e-mail.

6. Effective date and duration of the program

The member benefits from the program advantages from the date of joining, for an indefinite period, subject to termination by either party, in accordance with Article 1211 of the Civil Code and non-compliance with the conditions provided for by the Consumer Code.

7. Obligations of members

By joining the program, each member undertakes not to compromise public order, to respect applicable laws and regulations, and to respect the rights of third parties and the provisions of these General Terms.

In particular, each member must:

act fairly towards B&B HOTELS;
each member must provide truthful information to B&B HOTELS;
use the program's benefits in accordance with its purposes, as described in these General Terms, without altering its purposes to commit crimes, offenses or contraventions punishable under the legal system;
comply with the requirements regarding personal data protection and communication confidentiality;
comply with intellectual property requirements;
not alter any information published by B&B HOTELS;
refrain from any action that may alter, slow down or interrupt the normal functioning of the program.

8. Program cancellation

8.1 Cancellation from the program by the member

Members can request to be removed from the program at any time directly from their account or by sending a request via the contact form.

B&B HOTELS will proceed with the user's cancellation from the program as soon as possible and will send a confirmation email.

Cancellation of membership in the program will result in the deletion of the personal B&me account and the loss of all unused benefits related to the program, from the date of receipt of the cancellation request.

8.2 Termination of program membership by B&B HOTELS

Membership in the program may be terminated by B&B HOTELS in case of a breach by the member of the obligations set forth in these general terms and conditions, which may arise in particular from fraudulent behavior or non-compliance with the program eligibility conditions referred to in Article 3 (lack of legal capacity, etc.).

9. Liability

B&B HOTELS cannot be held liable if the non-performance or improper performance of these general terms and conditions is attributable to the member, to the action of a third party, or in case of force majeure, as defined by law.

10. Changes to the loyalty program

These general terms and conditions may be amended and updated by B&B HOTELS at any time, in particular to adapt to legislative or regulatory changes.

The applicable general terms and conditions are those in force at the time of Browse the website.

Members will be informed of any substantial changes by e-mail at the latest thirty (30) days before the changes come into effect.

11. Personal data protection

B&B HOTELS collects and processes the personal data of its members in compliance with the regulations applicable to personal data protection, in particular EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 and subsequent amendments and additions.

Members have the right to access, modify, rectify, object, portability and limitation according to the terms and conditions defined in the Privacy Policy.

12. Intellectual property

These conditions do not imply any transfer of property rights of any kind, particularly intellectual property.

In any case, the member is prohibited from taking any action or performing any act that may directly or indirectly infringe the intellectual property rights of B&B HOTELS.

In this regard, it is specified that the content of the website, the general structure as well as the trademarks, designs, models, images, animated or not, texts, photographs, logos, graphic charts, software and programs, search engines, databases, sounds, videos, domain names, design and all other elements composing the articles and the website or any other information appearing therein, without this list being exhaustive, are the exclusive property of B&B HOTELS or its partners or third parties who have granted it a license, and are protected by intellectual property rights that are or will be recognized to them in accordance with current laws.

Any reproduction and/or representation, total or partial, of any of these elements, without the express authorization of B&B HOTELS, is prohibited and would constitute an infringement punishable under the provisions of the Intellectual Property Code.

13. General provisions

If any of the clauses of these general terms and conditions is deemed unenforceable by a court decision, the other provisions will remain in force.

The information provided by the hotels-bb.com website is binding between the parties. Elements such as the date and time of receipt or transmission, as well as the quality of the data received, will be considered authentic in priority as they appear in the information systems of B&B HOTELS, unless the member provides written proof to the contrary, in original and signed.

14. Disputes

14.1 Regarding consumer clients

These general terms and conditions will be applied in accordance with Italian law. In case of dispute, the member is invited to contact B&B HOTELS customer service in order to obtain an amicable resolution.

The competent court for any claim or dispute that may arise from or concern these general terms and conditions is that of the place where the consumer is domiciled or has their residence. It is understood that nothing contained in these general terms and conditions prejudices or limits the consumer's right to file a complaint with an alternative dispute resolution institution as provided for by the Consumer Code (Legislative Decree 206/2005).

14.2 Regarding professional clients

The parties will seek to amicably resolve any dispute that may arise between them regarding the interpretation, execution or termination of these general terms and conditions.

In the absence of an amicable agreement between the parties within one (1) month from notification, the dispute will be submitted to the competent court, to which jurisdiction is expressly attributed.
