1.Preambolo

Le presenti condizioni generali (di seguito "condizioni generali") hanno lo scopo di disciplinare i diritti e i doveri dei membri del programma B&me (di seguito "membri") e delle le seguenti società:

di seguito denominata "B&B HOTELS" o la "Società".

B&B HOTELS mette a disposizione dei propri soci un servizio clienti accessibile via e-mail inviando una richiesta tramite il Modulo di contatto.

2. Scopo e ambito di applicazione

B&B HOTELS offre un programma di fidelizzazione B&me ai propri clienti professionisti e consumatori, ai sensi della legge sul consumo, attraverso il sito hotel-bb.com e la sua applicazione mobile, dedicate alla prenotazione di servizi alberghieri.

Accettazione dei presenti termini e condizioni con la creazione di un account nell'area clienti "B&me implica la conclusione di un contratto elettronico stipulato gratuitamente per aderire al programma di fidelizzazione B&me (di seguito il "programma").

Creando un account B&me, i membri entrano a far parte del programma B&me e accettano senza riserve i presenti termini e condizioni.

Gli iscritti sono espressamente informati che i presenti termini e condizioni generali non disciplinano:

l'utilizzo del sito, che è regolato dalle Condizioni Generali di Utilizzo del Sito, accessibili qui.
La prenotazione di un soggiorno, che è regolato dalle condizioni generali di vendita, consultabili qui.
L'abbonamento a pagamento al programma B&me CLUB, riservato ai soci che hanno sottoscritto il programma B&me, regolato dalle Condizioni generali consultabili qui.

3. Condizioni di ammissibilità al programma

Per aderire al programma, gli iscritti devono :

avere almeno diciotto (18) anni e/o la capacità giuridica (B&B HOTELS si riserva il diritto di effettuare qualsiasi verifica per accertare la capacità dell'iscritto di partecipare al programma).

Il programma si applica sia ai consumatori che ai professionisti ai sensi del D.Lgs 6 settembre 2005, n. 206 Codice del Consumo.

per cliente consumatore si intende una persona fisica che agisce per scopi estranei alla propria attività commerciale, industriale, artigianale, liberale o agricola;
per cliente professionale si intende qualsiasi persona fisica o giuridica, pubblica o privata, che agisce per scopi connessi alla propria attività commerciale, industriale, artigianale, liberale o agricola, anche quando agisce in nome e per conto di un altro professionista.

B&B HOTELS si riserva il diritto di effettuare qualsiasi verifica per garantire la capacità dell'iscritto di partecipare al programma.

4. Partecipazione al programma

4.1 Registrazione al programma

L'scrizione al programma B&me è libera e gratuita:

compilando il form e attivando un account, disponibile in francese, inglese, spagnolo, portoghese, tedesco e italiano, sul sito oppure sull'applicazione mobile di B&B HOTELS.
quando si prenota una camera su questo sito;
direttamente in hotel alla reception.

Le informazioni che il membro fornisce a B&B HOTELS al momento dell'adesione al programma devono essere complete, aggiornate, sincere e in nessun modo fuorvianti.

B&B HOTELS si riserva il diritto di chiedere all'iscritto di confermare, con qualsiasi mezzo appropriato, la sua identità, la sua idoneità e le informazioni fornite.

Gli iscritti sono informati e accettano che le informazioni inserite al momento dell'iscrizione al programma costituiscano una prova della loro identità. Le informazioni fornite dagli iscritti sono vincolanti non appena sono state convalidate.

Di conseguenza, l'iscritto si impegna ad aggiornare tali informazioni sul proprio account in modo che corrispondano sempre ai criteri di cui sopra o a informare B&B HOTELS di eventuali modifiche apportate tramite il Modulo di contatto.

L'iscrizione è personale e solo l'iscritto al programma può usufruirne. L'utilizzo del programma da parte di persone diverse dall'iscritto è vietato.

Si dichiara espressamente che il programma è interamente digitale. Pertanto, al momento dell'iscrizione al programma, non verrà consegnato o inviato alcun supporto fisico (ad esempio una carta fedeltà).

4.2 Accettazione dei termini e delle condizioni

L'iscritto si impegna a leggere attentamente le presenti condizioni generali di contratto prima di iscriversi al programma sul sito e le accetta espressamente confermando la creazione dell'account.

L'iscrizione al programma presuppone la presa visione e accettazione dei termini e condizioni riportati in fondo a ogni pagina del sito web, con la possibilità di scaricarli.

5. I vantaggi del programma

Il Programma B&me consente ai clienti di beneficiare dei vantaggi qui descritti (variabili da un Paese all'altro).

I vantaggi del Programma B&me:

non sono trasferibili;
non sono rimborsabili;
non sono cumulabili con prenotazioni effettuate con un codice aziendale;
possono essere utilizzati solo quando sono state effettuate prenotazioni sul Sito e sull'Applicazione.

L'iscritto è espressamente informato che i vantaggi offerti dal programma B&me sono soggetti a modifiche e sarà informato di qualsiasi cessazione definitiva del Programma B&me via e-mail.

6. Data di entrata in vigore e durata del programma

L'iscritto beneficia dei vantaggi del programma a partire dalla data di adesione, a tempo indeterminato, con riserva di risoluzione da una delle parti, ai sensi dell'articolo 1211 del Codice Civile e mancato rispetto delle condizioni previste dal Codice del Consumo.

7. Obblighi degli iscritti

Iscrivendosi al programma, ogni iscritto si impegna a non compromettere l'ordine pubblico, a rispettare le leggi e i regolamenti vigenti e a rispettare i diritti di terzi e le disposizioni delle presenti Condizioni Generali.

In particolare, ogni iscritto deve :

comportarsi secondo correttezza nei confronti di B&B HOTELS;
ogni iscritto deve fornire informazioni veritiere a B&B HOTELS;
utilizzare i vantaggi del programma conformemente alle sue finalità, come descritto nelle presenti Condizioni generali, senza alterarne le finalità per commettere crimini, reati o contravvenzioni punibili ai sensi dell'ordinamento;
rispettare le prescrizioni in materia di protezione dei dati personali e la riservatezza delle comunicazioni;
rispettare le prescrizioni in materia di proprietà intellettuale;
non alterare qualsiasi informazione pubblicata da B&B HOTELS;
astenersi dal porre in essere qualsivoglia azione che possa alterare, rallentare o interrompere il normale funzionamento del programma.

8.Cancellazione del programma

8.1 Cancellazione dal programma da parte dell'iscritto

Gli iscritti possono chiedere di essere rimossi dal programma in qualsiasi momento direttamente dal loro account o inviando una richiesta tramite il modulo di contatto.

B&B HOTELS procederà con la cancellazione dell'utente dal programma il prima possibile e invierà un'e-mail di conferma.

L'annullamento dell'iscrizione al programma comporterà la cancellazione dell'account B&me personale e la perdita di tutti i vantaggi non utilizzati legati al programma, a partire dalla data di ricezione della richiesta di cancellazione.

8.2 Cessazione dell'iscrizione al programma da parte di B&B HOTELS

L'iscrizione al programma può essere annullata da B&B HOTELS in caso di violazione da parte dell'iscritto degli obblighi previsti dalle presenti condizioni generali, che possono derivare in particolare da un comportamento fraudolento o dal mancato rispetto delle condizioni di ammissibilità al programma di cui all'articolo 3 (mancanza di capacità giuridica, ecc.).

9. Responsabilità

B&B HOTELS non potrà essere ritenuta responsabile nel caso in cui la mancata o cattiva esecuzione delle presenti condizioni generali sia imputabile all'iscritto, all'azione di soggetto terzo, o in caso di forza maggiore, così come definito dall'ordinamento.

10. Modifiche al programma fedeltà

Le presenti condizioni generali possono essere modificate e aggiornate da B&B HOTELS in qualsiasi momento, in particolare per adeguarsi a cambiamenti legislativi o regolamentari.

Le condizioni generali applicabili sono quelle in vigore al momento della navigazione sul sito.

Gli iscritti saranno informati di eventuali modifiche sostanziali via e-mail al più tardi trenta (30) giorni prima dell'entrata in vigore delle modifiche.

11. Protezione dei dati personali

B&B HOTELS raccoglie e tratta i dati personali dei propri iscritti nel rispetto delle normative applicabili alla protezione dei dati personali, in particolare del Regolamento UE 2016/679 del Parlamento europeo e del Consiglio del 27 aprile 2016 e successive modifiche e integrazioni.

Gli iscritti hanno il diritto di accesso, modifica, rettifica, opposizione, portabilità e limitazione secondo i termini e le condizioni definiti nella Politica sulla privacy.

12. Proprietà intellettuale

Le presenti condizioni non implicano alcun trasferimento di diritti di proprietà di qualsiasi tipo, in particolare di proprietà intellettuale.

In ogni caso, all'iscritto, è vietato intraprendere qualsiasi azione o compiere qualsiasi atto che possa violare direttamente o indirettamente i diritti di proprietà intellettuale di B&B HOTELS.

A tale proposito, si precisa che il contenuto del sito, la struttura generale nonché i marchi, i disegni, i modelli, le immagini, animate o meno, i testi, le fotografie, i loghi, le carte grafiche, i software e i programmi, i motori di ricerca, le banche dati, i suoni, i video, i nomi di dominio, il design e tutti gli altri elementi che compongono gli articoli e il sito o qualsiasi altra informazione che vi compaia, senza che tale elenco sia esaustivo, sono di proprietà esclusiva di B&B HOTELS o dei suoi partner o di terzi che le hanno concesso una licenza, e sono protetti dai diritti di proprietà intellettuale che sono o saranno loro riconosciuti in conformità alle leggi vigenti.

Qualsiasi riproduzione e/o rappresentazione, totale o parziale, di uno qualsiasi di questi elementi, senza l'espressa autorizzazione di B&B HOTELS, è vietata e costituirebbe, una violazione punibile ai sensi delle disposizioni del Codice della Proprietà Intellettuale.

13. Disposizioni generali

Se una delle clausole dei presenti termini e condizioni generali è considerata inapplicabile da una decisione del tribunale, le altre disposizioni rimarranno in vigore.

Le informazioni fornite dal sito hotels-bb.com fanno fede tra le parti. Elementi quali la data e l'ora di ricezione o di trasmissione, nonché la qualità dei dati ricevuti, saranno considerati autentici in via prioritaria così come appaiono nei sistemi informativi di B&B HOTELS, a meno che l'iscritto non fornisca una prova contraria scritta, in originale e firmata.

14. Contenzioso

14.1 Per quanto riguarda i clienti consumatori

Le presenti condizioni generali saranno applicate in conformità alla legge italiana. In caso di controversia, l'iscritto è invitato a contattare il servizio clienti di B&B HOTELS al fine di ottenere una soluzione consensuale.

Per qualsiasi informazione o reclamo, il servizio clienti di B&B HOTELS è a disposizione dell'iscritto:

Il foro competente per qualsiasi reclamo o controversia che possa derivare o riguardare i presenti termini e condizioni generali è quello del luogo in cui il consumatore è domiciliato o ha la propria residenza. Resta inteso che nulla di quanto contenuto nelle presenti condizioni generali pregiudica o limita il diritto del consumatore di presentare un reclamo presso un istituto di risoluzione alternativa delle controversie secondo quanto previsto dal Codice del Consumo (D.Lgs. 206/2005).

In conformità all'articolo 14 del regolamento (UE) n. 524/2013, la Commissione europea offre una procedura di risoluzione delle controversie online sulla sua piattaforma di risoluzione delle controversie online: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show

14.2 Per quanto riguarda i clienti professionali

Le parti cercheranno di risolvere amichevolmente qualsiasi controversia che possa sorgere tra loro in merito all'interpretazione, all'esecuzione o alla risoluzione delle presenti condizioni generali.

In mancanza di un accordo amichevole tra le parti entro un (1) mese dalla notifica, la controversia sarà sottoposta al tribunale competente per giurisdizione, al quale ne è espressamente attribuita la competenza.
