General Terms and Conditions - "Sport" Offer

The General Terms and Conditions of the "Sport" offer (hereinafter the "Offer") are detailed below. The Offer is proposed by the following companies:

B&B HOTELS FRANCE, a limited liability company, registered with the Trade and Companies Register of Brest under number 378 047 500, with its registered office located at 271 rue du Général Paulet, 29200 Brest, France. 

Acting both in its own name and on behalf of (i) its subsidiaries and (ii) the hotel operating companies of the B&B HOTELS group participating in this Offer;

TANDEM SAS, a simplified joint-stock company, registered with the Trade and Companies Register of Paris under number 908 119 746, with its registered office located at 9 boulevard Romain Rolland, 75014 Paris, France;

B&B TAKEOVER, a simplified joint-stock company, registered with the Trade and Companies Register of Brest under number 904 728 649, with its registered office located at 271 rue du Général Paulet, 29200 Brest, France;

B&B DREAMLAND HOTEL, a simplified joint-stock company registered with the Trade and Companies Register of Brest under number 808 416 960, with its registered office located at 271 rue du Général Paulet, 29200 Brest, France. (Hereinafter as "B&B HOTELS")

Definitions

In these General Terms and Conditions, the following expressions shall have the meaning set out below:

• Hotel(s): means all present and future hotels in the B&B HOTELS network, located on French territory and operated by B&B HOTELS as subsidiaries, managed by legally independent third-party companies, or operated as franchises;
• Client: means the company or association that has subscribed to the Offer;
• Beneficiary(ies): means the Client's members, namely licensed athletes and/or members, as well as their accompanying persons benefiting from the SPORT Offer.
• Party(ies): means B&B HOTELS and the Client.

Description of the offer

By subscribing to the Offer, the Client benefits from a rate subject to the following terms:

• Rate of €30 per person for rooms accommodating 2, 3, or 4 people. Breakfast included. Cancellable until 7 p.m. on the day of arrival.
• Rate of €50 for a single room (1 person). Breakfast included. Cancellable until 7 p.m. on the day of arrival.

Rate applicable up to a maximum of 9 rooms, exclusively in France, by entering a code directly on the B&B HOTELS website or mobile application. Valid on Fridays, Saturdays, Sundays, public holidays, and the day before public holidays, and during all school holidays zones combined, subject to room availability at this rate, non-combinable with the loyalty program and any promotional offer, special rates, special offers/or promotions or seasonal discounts, upon presentation of the required supporting documents upon arrival at the hotel (valid license and proof of competition, training, meeting, etc.) and applicable to accompanying persons (managers, doctors, referees, supporters, etc.)

The Offer is reserved for individual Clients (the Beneficiaries) and therefore excludes group bookings. For group bookings (reservation of at least 10 rooms per night), the Client is invited to request a price quote from the Groups department via this link.

Eligibility

To subscribe to the Offer, the Client must meet each of the following conditions:

• Be registered as a company;
• Not be a travel agency, wholesaler, or intermediary distributor;

Notwithstanding any contrary provision contained herein, B&B HOTELS shall be the sole judge of a Client's eligibility or non-eligibility to benefit from the Offer.

Subscription

Subscription to the Offer is free of charge.

The Client must complete the registration form available here and accept these General Terms and Conditions applicable to the Offer.

Subscription to the Offer is confirmed by sending the Client a confirmation email containing a unique code.

The Client accepts that the Offer may be modified or terminated in whole or in part at any time without prior notice.

Duration

The Offer takes effect upon receipt of the confirmation email by the Client and remains valid for an initial period of one (1) year.

The Offer is automatically renewed for successive periods of one (1) year.

Booking conditions

Booking requests are mandatory and must be made by the Client or the Beneficiary before the Beneficiary's arrival date:

• either by telephone with the central reservation office at the dedicated number +33 (0)9 77 42 27 25 (cost of a local call) from 8:45 am to 10:00 pm Monday to Friday, from 8:45 am to 7:00 pm on Saturday, and from 11:00 am to 5:00 pm on Sundays and public holidays;
• or on the B&B HOTELS website (www.hotel-bb.com) or the B&B HOTELS mobile application;

In order to benefit from the Offer, the person making the reservation must provide the code communicated by B&B HOTELS at the time of the Client's subscription to the Offer.

Invoicing and payment

Invoices are issued by the Hotel and are payable by each Beneficiary upon arrival at the Hotel reception using the payment method of their choice, including ‘’chèques vacances’’ (ANCV holiday vouchers). However, it is not possible for them to make payment using a credit card (e-carte bleue) or ANCV e-connect.

Visa Electron and Maestro bank cards are not accepted to guarantee a reservation but may be accepted for payment at the hotel.

Client obligations

The Client must ensure that the code is not made available and/or used by travellers who do not qualify as Beneficiaries within the meaning of these General Terms and Conditions.

The Client undertakes to inform the Beneficiaries of the existence of the Offer and to provide them with the associated General Terms and Conditions via appropriate internal communication.

Termination

Breach of the General Terms and Conditions

In the event of a breach by one of the Parties or by a Beneficiary of any of the obligations provided for in these General Terms and Conditions, the other Party may terminate this Offer. Termination shall take effect automatically upon expiry of a period of thirty (30) calendar days following a formal notice sent by registered letter with acknowledgment of receipt, which remains without effect from the date of its reception.

The exercise of this right of termination does not exempt the defaulting Party from fulfilling the obligations subscribed until the effective date of termination, without prejudice to the remedies that the other Party may have.

Insufficient volume of nights

The Offer may be terminated by B&B HOTELS at the end of the initial duration or any renewal period if the volume of nights purchased by the Client is insufficient to qualify for a discount.

Acceptance of these General Terms and Conditions

By ticking the box "I accept the General Terms and Conditions", the Client finalises their subscription to the Offer. This means that they confirm having read, understood, and accepted all the conditions of the Offer set out above, including B&B HOTELS' privacy policy.

Governing law and jurisdiction

These General Terms and Conditions are governed by French law.

In the event of a dispute, the Parties undertake to take all reasonable measures to resolve their dispute amicably. Failing an amicable settlement within a period of thirty (30) calendar days from the notification of the dispute by either Party, the said dispute may be submitted to the Commercial Court of Paris, to which the Parties attribute exclusive jurisdiction.

Application of B&B HOTELS General Terms and Conditions of Sale

Any reservation made under this Offer implies the full and unreserved acceptance by the Client and the Beneficiaries of the provisions of B&B HOTELS' General Terms and Conditions of Sale (hereinafter the "GTCs"), available here, which detail the booking and stay conditions in the Hotels.

In the event of a contradiction between these General Terms and Conditions and the GTCs, the former shall prevail over the latter.
